HomeMy WebLinkAbout6957_CCv0001.pdf RESOLUTION NO. 6957 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING AN AMENDMENT TO SIGN CONDITIONAL USE PERMIT NO. 2 TO PERMIT THE ADDITION OF THREE (3) PANELS TO TWO EXISTING FREEWAY SIGNS (APPLICANT: ANDERSON WEST, LLC) BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. The City Council of the City of Redlands hereby approves the Negative Declaration, in the form attached hereto as Exhibit"A," for an amendment to Sign Conditional Use Permit No. 2 permitting the addition of three panels to two existing signs. Section 2. The City Council of the City of Redlands hereby approves an amendment to Sign Conditional Use Permit No. 2 to permit the addition of three panels to two existing signs, subject to the conditions of approval attached hereto as Exhibit"B," and based upon the following findings: (1) The size of the existing sign, with the addition of the proposed new panels, is compatible with the design, architecture and scale of the existing development on site because the new panels are ivory and purple in color, with dimensions of twenty(20) feet in width, and four (4) feet in height, and thus the color design mass and scale of the sign will not significantly change. Also, the existing on-site development, having approximately 400,000 square feet of retail space and located on forty(40) acres with frontage on Colton, Industrial Park Avenue and the I-10 freeway is sufficiently large in square footage to be proportional to the size of the sign, which is nine hundred sixty eight(968) square feet and eighty(80) feet in height. (2) The size of the sign is aesthetically consistent with the on-site development and adjacent projects; and the proposed panels are designed to match the existing panels with violet and ivory coloring, having a dimension of twenty (20) feet in width and four (4) feet in height. In addition, the proposed panels internally illuminated and are aesthetically consistent with the adjacent urban setting, because there are several other internally illuminated, freeway oriented signs in the area. (3) The existing sign advertises a regional shopping center with interior facing tenant buildings situated approximately twenty (20) feet lower than freeway lanes, thus limiting visibility of building signage. The new additional panels will accommodate individual tenant identification signs into a single easily recognizable sign, minimizing visual clutter, that would benefit the general public along a stretch of Interstate 10 freeway where approximately 140,000 vehicles travel on a daily basis. Project Location: The project site is located in the Tri-City Shopping Center along Industrial Paris Avenue, between Alabama Street and Tennessee Street, and adjacent to the Interstate-10 Freeway. S. Zoning: The zoning designation of the project site Is within the General Commercial District of the East Valley Corridor Specific Plan. 8. Description of Project: The proposed project will add tree,80 square sign panels to two existing freeway oriented signs (3 panels per sign) within a regional shopping center known as Tri-City. Once installed, the total sign area will increase by 275 square feet.for a total of 883 square feet per sign. The existing signs were approves! in February of 2000 by the Redlands City Council with a height of 80 feet and a cumulative sign area of 688 square feet each. The signs consist of two columns supporting the sign face.The sing face it located 59 feet from grade and contains a 243 square foot center identfication sign. In addition to the sign face the pilasters support one 20 foot wide by 4 foot tall tenant panel. The signs are located at the northeast and northwest corners of the project site near the 1-10 freeway frontage. Initial Study for Sign Conditional Use Permit No. 2(Revision No. 1) FVl.til'YI MJF Page 1 Exhibit "B" COMMUNITY DEVELOPMENT DEPARTMENT PLANNING DIVISION CONDITIONS OF APPROVAL FOR SIGN CONDITIONAL USE PERMIT NO. 2 (Revision No. 1) Applicant: Anderson West Location: Tri City Shopping Center 1. The approval is for a Conditional Use Permit to add three (3), 80 square foot sign panels to two (2) existing 688 square foot freeway-oriented signs, within the Tri-City Shopping Center located along Industrial Park Avenue, between Tennessee Street and Alabama Street in the EV/CG (General Commercial) District of the East Valley Corridor Specific Plan. 2. This project shall comply with all permits requirements of the Redlands Municipal Code. 3. The applicant shall obtain Building Permits from the Community Development Department. 4. All plans submitted to the City shall reflect all City Council approvals and any other changes required by the City Council and/or staff. This condition applies to site plans, elevations, and all other illustrations, text, or plans submitted to the city in connection with the project. 5. The applicant for this permit, and its successors and assigns, shall defend, indemnify and hold harmless the City of Redlands, and its elected officials, officers, agents and employees, from and against any and all claims, actions, and proceedings to attack, set aside, void or annul the approval of this permit by the City, or brought against the City due to acts or omissions in any way connected to the applicant's development project that is the subject of this permit. This indemnification shall include, but not be limited to, damages, fees, costs, liabilities, and expenses incurred in such actions or proceedings, including damages for the injury to property or persons, including death of a person, and any award of attorneys' fees. In the event any such action is commenced to attack, set aside, void or annul all, or any, provisions of this permit, or is commenced for any other reason against the City for acts or omissions relating to the applicant's development project, within fourteen (14) City business days of the same, the applicant shall file with the City a performance bond or irrevocable letter of credit (together, the "Security") in a form and in an amount satisfactory to the City, to ensure applicant's performance of its defense and indemnity obligations under this condition. The failure of the applicant to provide the Security shall be deemed an express acknowledgement and agreement by the applicant that the City shall have the authority and right, without objection by the applicant, to revoke all entitlements granted for the sign pursuant to this permit. The City shall have no liability to the applicant for the exercise of City's right to revoke this permit and any associated entitlements. 6. Tenant Panels shall have a minimum separation of seven(7) inches.
