HomeMy WebLinkAbout525_CCv0001.pdf 2 RESOLUTION OF INTET"I T ION TO GRANT ELECTRIC 'fs4Cr: IE 3 � S- 7 4 VMEREAS, SOUTHERN CALIFORNIA EDISON COMFANY LTD., a 5 California utility corporation, has filed with the Council of the B City of Redlands an application requesting that a franchise be E 7 granted to it of the character and for the purposes mentioned in 8 the form of notice hereinafter set forth; and 9 1'MREAS in the opinion of said Council the public good 10 requires that said franchise be granted; 11 NO`t'i, 'THEREFORE, BE IT RESOLVED that said Council intends 12 to grant said franchise, that hearing of objections to the grant- 13 ing thereof will be held at the time and place specified in the 14 notice hereinafter set forth which the Clerk of said City is 15 hereby directed to publish at least once within fifteen days after 16 the passage of this resolution in a newspaper of general circula- 17 tion within said City. 18 Said notice is in the following words and figures: 19 "NOTICE OF INTEIv'TION TO GRL;1T FRANCHISE. 20 NOTICE IS HEREBY GIVEN that Southern California 21 Edison Company Ltd., a California utility corporation, 22 has filed its application with the Council of the City 23 of Redlands requesting said Council to grant it a fran- 24 chise for an indeterminate period, as provided in the 25 Franchise Act of 1.9379 (1) to use, for transmitting and 26 distributing electricity and electrical energy within 27 said City for any and all purposes other than those 28 authorized under Section 19 of Article 1I of the Consti- 29 tution of the State of California, as said section 30 existed prior to its amendment on October 10, 1911, all 31 poles, wires, conduits, and appurtenances that are 32 now or hereafter may be lawfully placed in the s 2 public streets, alleys, ways and places within the said 3 city, and (2) to construct and use in said public streets 4 all poles, wires, conduits, and appurtenances necessary 5 or proper for said purposes. 6 If said franchise shall be granted to it, said q Southern California Edison Company Ltd., its successors 8 and assigns, hereinafter designated grantee, shall, dur- 9 ing the life thereof, pay to said City two per cent of 10 the gross annual receipts of said grantee arising from 11 the use, operation or possession of said franchise; 12 provided, however, that such payment shall in no event 13 be less than a sum which shall be equivalent to one-half 14 of one per cent of the gross annual receipts derived by 15 grantee from the sale of electricity and electrical 16 energy within the limits of said City under both the fran- 17 ' chisesto be granted and the franchise now owned by said 18 grantee by virtue of Section 19 of Article XI of the 19 Constitution of the State of California as said section 20 existed prior to its amendment on October 14, 1911. 21 NOTICE IS HEREBY FURTER, GIVEN that any and all 22 persons having any objections to the granting; of said t 23 franchise may appear before said Council at the City Hall 24 of said City at the hour of-7-0'clock p.m. on 1"AC10 , 25 theZ12X day of OCAL-'F-- , 19379 and be heard 26 thereon; and 27 NOTICE IS =-MEBY KTRTHER GIVEN that at any time 28 not later than the hour so set for hearing objections, 29 any person interested may make written protest stating 30 his objections against the granting of said franchise 31 which protest must be signed by the protestant and 32 ' r 3 I delivered to the City Clerk of said Cityq and the Council 2 shall at the time set for hearing said objections proceed 3 to hear and pass upon fill protests so made; and 4 NOTICE IS HEREBY FURTHER GIVEN that the grantee of 5 said franchise must within five days after the date of 6 granting same file with the Council of said City a bond 7 in the penal sum of One Thousand Dollars ($1,000.00) 8 running to said City with at least two good and sufficient 9 sureties thereto to be approved by said Council conditioned 10 that such grantee shall well and truly observe,, fulfill and Z1 perform each and every term and condition of said franchise 12 and that in case of any breach of condition of said bond . 13 occurring the whole amount of the penal sum therein named 14 shall be taken and deemed to be liquidated damages and 15 shall be recoverable from the principal and sureties upon 16 said bond. 171 For further particulars reference is hereby 18 made to said application filed as aforesaid in the office 19 of said City Clerk, and also to the resolution adopted by 20 said City Council on the day of � 1937 , 21 declaring its intention oto grant said franchise. 22 Dated: ✓" 19z7- 23 By order of the Council of the City of Redlands. 24 ! 25 City Clerk, City of Redlands.
