3 V=REAS, investigation having developed the fact
that southern California Ldison Company Ltd. has been t
4 operating and maintaining in the public streets , thorough- [
fares and public places in the City of Redlands for a 1 >�

5 number of years an electric transmission and distribution
system consisting of poles, wires, conduits and appurte- '
e nanoes, without making any payments to the City of i
Redlands of 2Vo of the gross receipts derived by said
7 ,[ company from its use , operation and possession of certain
franchise rights , and

W- EREAS, the matter having been called to its
9 attention Southern California Edison Company i'td. has I
offered to pay to the City of Redlands the sum of Four
10 Thousand Nine Hundred Sixty-three and 40/100 Dollars
( ` 4,963.40) in full settlement of all amounts due said
11 city under said franchise rights up to and including
1
the 18th day of a�ovember, 193? , and

WHEREAS, the City 'ttorney has recommended the
13 acceptance of such settlement on the ground that the
recovery of a greater amount would, in his opinion , be
141 barred by the statute of ?imitations , and

15iN11EREAS, it is to the best interest of the City
of Redlands that the offer of Southern California Edison
16Company Ltd. in the sum of Four Thousand Nine Hundred
Sixty-three and 40A00 Dollars ($4,963.40) be accepted
1711 in full settlement and payment of any and all claims the
City of Rediands may have against Southern California
18 Edison Company Ltd. arising out of the use, operation
and possession of the franchises claimed and owned by
19 Southern California Edison Company Ltd.

20 NOW, THEREFORE, BE _�ND IT IS HEREBY RESOLVED
BY THE CITY COUNCIL OF THE CITY OF REDLANDS, as follows:

Section 1. The City Council of the City of f
22 Redlands does hereby accept from Southern California
Edison Company Ltd. the sur of Four Thousand Nine
23 Hundred Sixty-three and 40/30 Dollars 04,963.40) in
full settlement of any and all amounts due said city
24 up to and including the 18th day of iuovember, 1937 , j
on account of 2;0 of the gross annual receipts derived
25 by said Southern California Edison Company Ltd. from
its use , operation and possession in said City of
26 � Redlands of all franchises heretofore granted by the
City of Redlands to Southern California Edison Company i
try Ltd. , and its predecessors. j
28 The City Clerk of the City of Redlands shall
certify to the passage and adoption of this resolution
29 and its approval by the 1ayor, and upon receipt of the
sum of Four Thousand Mine Hundred Sixty-three and 40/100
30 j Dollars 04,963.40) shall furnish a certified copy there-
of to Southern California Ldison Col sany Ltd. r
