HomeMy WebLinkAbout4190_CCv0001.pdf RESOLUTION NO. 4190 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THE VALUE OF WRITTEN PROTESTS AND ORDERING MUNICIPAL REORGANIZATION NO. 2388 CONSISTING OF ANNEXATION NO. 60-A SUBJECT TO CONFIRMATION OF VOTERS WITHIN THE AFFECTED TERRITORY AND TO THE TERMS AND CONDITIONS AS APPROVED BY THE LOCAL AGENCY FORMATION COMMISSION AND CALLING AN ALL-MAIL BALLOT SPECIAL ELECTION THEREFOR THE CITY COUNCIL OF THE CITY OF REDLANDS RESOLVES AS FOLLOWS; SECTION 1. RECITALS. (A) Pursuant to the Cortese/Knox Local Government Reorganization Act (Government Code Section 56000 et seq) proceedings were initiated by the City Council of the City of Redlands by adoption of Resolution No. 4092 on August 20, 1985, for the annexation of inhabited territory generally located south and east of the City limit line, south of the I-10 Freeway, west of Knoll Drive and Goldhill Lane, and generally north of Live Oak Canyon Road, and described in Exhibit A which is attached hereto and incorporated herein as though fully set forth. (B) The Local Agency Formation Commission of the County of San Bernardino adopted its Resolution No. 2053 on July 16, 1986, making determinations and approving the proposed annexation to the City of Redlands of territory described in the attached Exhibit A. (C) The annexation of the hereinafter described territory will contribute to the orderly growth of the City, provide the proper control of street layout, drainage, sanitary sewer design, and insure the proper use of land in conformity with the overall plan of the City. (D) The regular county assessment roll is utilized by this City. (E) The affected territory will be taxed for existing general bonded indebtedness of this City. (F) Notice of a public hearing on the proposed annexation held on September 16, 1986, at 7.00 P.M. in the Council Chambers, 212 Brookside Avenue, was duly published by the City Clerk, together with a notice that protests could be filed with the City Clerk by any owner of land or registered voter within the territory proposed for annexation. RESOLUTION NO. 4190 PAGE 2 (G) A public hearing of protests having been held as noticed on September 16, 1986, and continued to November 4 , 1986, it is determined that at least twenty-five percent (25%) but less than fifty percent (50%) of the registered voters residing within the affected territory have filed written protests against the annexation. (H) Pursuant to Government Code Section 57075, an election shall be called and held on the question of whether this municipal reorganization shall be confirmed. SECTION 2. VALUE OF WRITTEN PROTESTS. The value of the written protests filed up until the commencement of the public hearing on September 16 , 1986, is at least twenty-five percent (25%) but less than fifty percent (50%) of the registered voters residing within the territory to be annexed. SECTION 3. ANNEXATION ORDERED. Subject to confirmation of the voters within the affected territory, annexation of the unincorporated area legally described in the attached Exhibit "A" is hereby ordered. A map showing the area to be annexed is attached hereto as Exhibit "B" and incorporated herein as though fully set forth. Pursuant to Condition No. 5 of LAFC Resolution No. 2053 , the effective date of this municipal reorganization shall be the date of issuance of the Certificate of Completion. This reorganization shall be subject to the following conditions as contained in LAFC Resolution No. 2053 : 1. The conducting authority for this proceeding shall be the City Council of the City of Redlands. 2. The boundaries are approved as set forth in Exhibit "A" attached hereto. 3 . The following distinctive short fora designation shall be used throughout this proceeding: LAFC 2388. 4 . Included in the City' s resolution depicting final action shall be the detachment of County Service Area SL-1, County Service Area 38, and County Service Area 70 without split of assets or liabilities. 5 . The date of issuance of the Certificate of Completion shall be the effective date of this annexation. RESOLUTION NO. 4190 PAGE 3 SECTION 4 . ALL-NAIL BALLOT SPECIAL ELECTION CALLED. In accordance with Section 1340 of the California Elections Code, an all-mail ballot special election is called and will be held on July 14, 1987 , in the unincorporated area legally described in the attached Exhibit "A" and shown on the map attached as Exhibit "B" for the purpose of submitting to the registered voters within said area, for their approval or disapproval, the order adopted on April 7, 1987► by the City Council of the City of Redlands ordering the annexation to said City of the territory described in said order and designated as Annexation No. 60-A, LAFC 2388. The order shall be confirmed if approved by a majority of the voters voting thereon.. SECTION 5. REQUEST FOR ELECTION SERVICES. The City Council of the City of Redlands hereby requests that the Board of Supervisors permit and direct the Registrar of Voters to conduct the City' s special annexation election. SECTION 6. MEASURE. The measure to be submitted and voted on at the special municipal election as it is to appear on the ballot shall be as follows: Shall the resolution adopted on April 7 , 1987 , by the City Council of the City of Redlands YES ordering the annexation of described unincorporated territory designated as Annexation No. 60-A, LAFC 2388 , be confirmed, subject to the NO terms and conditions specified in the resolution? The measure shall be designated on the ballot by a letter printed on the left margin of the square containing the description of the measure as provided in the Elections Code of the State of California. SECTION 7. CANVASS OF RETURNS. The Registrar of Voters of the County of San Bernardino is hereby authorized to conduct and canvass the returns of the special annexation election called by this resolution. Results of the election shall be certified to the City Council of the City of Redlands. RESOLUTION NO. 4190 PAGE 4 SECTION 8 . NOTICE OF ELECTION. Pursuant to Section 57131 of the Government Code, the City Clerk is hereby directed to published a notice of the annexation election which shall contain the following: (A) The date of the election; (B) That the last day for receipt of primary arguments for or against the measure has been established as 5:00 P.N. on April 21, 1987 , in the City Clerk ' s Office, City Rall, 30 Cajon Street, Redlands, California; (C) That the last day for receipt of rebuttal arguments is 5 :00 P.M. on April 28 , 1987 , in the City Clerk ' s office at the above location; (0) A statement of the proposition to be voted on and a general description of the boundaries of the territory to be annexed as set forth in Exhibits "A" and "B" attached hereto; (E) That the City Council or any member authorized by Council or bona fide association of citizens or any registered voter entitled to vote on the proposal is invited to submit and file with the City Clerk for printing and distribution in the ballot pamphlet an argument for or against the proposal; (F) That only one argument for and one argument against shall be selected by the City Clerk and printed; that such argument shall not exceed three hundred (300) words in length, shall be accompanied by not more than three (3) signatures, and shall be accompanied by the following statement signed by the author (s) of the argument: "The undersigned author (s) of the _ (primary/ rebuttal) argument (in favor of/against) ballot proposition (name or number) at the special election for the City of Redlands to be held on duly 14, 1987, hereby states that such argument is true and correct to the best of (his/her/their) knowledge and belief. " pursuant to Section 5350 of the Elections Code; and (G) That a majority vote of citizens entitled to vote on the proposition is required for confirmation of the annexation. RESOLUTION NO. 4190 PAGE 5 SECTION 9. TERRITORY, PRECINCTS, AND POLLING PLACES. The special election called by this resolution shall be held within the territory described in Exhibit "A" and shown on the map which is Exhibit "B" attached hereto and shall be held in such precincts and at such polling places as shall be determined by the Registrar of Voters of the County of San Bernardino. The Board of Supervisors of the County of San Bernardino is hereby requested to issue instructions to the Registrar of Voters to take any and all steps necessary for the holding of the special election. The City Council recognizes that costs will be incurred by the County for reason of this special election and agrees to reimburse the County for any such costs. SECTION 10. FILING BY CITY CLERK The City Clerk is hereby directed to file a certified copy of this resolution with the Executive Officer of the Local Agency Formation Commission of the County of San Bernardino by certified mail within five (5) days of the adoption hereof. The City Clerk is further directed to file certified copies of this resolution with the Board of Supervisors of the County of San Bernardino and the San Bernardino County Registrar of Voters.
