HomeMy WebLinkAbout4774_CCv0001.pdf RESOLUTION NO. 4774 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN BERNARDINO TO CONSOLIDATE SAID ELECTION WITH THE ELECTION TO BE HELD ON TUESDAY, NOVEMBER 5, 1991 WHEREAS, under the provisions of the laws relating to general law cities in the State of California, a special muni- cipal election shall be held on Tuesday, November 5, 1991, for the election of Municipal Officers; and WHEREAS, the City Council of the City of Redlands also desires to submit to the voters at the election a question relating to a utility users' tax; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS does hereby resolve, declare, determine and order as follows: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities, there is called and ordered to be held in the City of Redlands, California, on Tuesday, November 5, 1991, a special municipal election for the purpose of electing a Member of the City Council, District No. 2 for the full term of four years and a Member of the City Council, District No. 4 for the full term of four years, a City Clerk for the full term of four years, and a City Treasurer for the full term of four years; SECTION 2. That the City Council, pursuant to its right and authority, does order submitted to the voters at the Special Municipal Election the following question: Shall Ordinance No. 2162 be adopted to levy a utility users' tax on the citizens of Redlands in an amount not to exceed one YES and one-half percent, and with exemptions for seniors and low income persons, for the purpose of raising revenues to fund services provided by the City' s police department; and shall the NO City' s appropriation limit be increased by the amount of revenue derived from the paid tax? A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the question. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the measure. Pursuant to Section 4013 of the California Elections Code, this ordinance shall become a valid and bind ordinance of the City only if two- thirds of the voters voting on the ordinance vote in its favor. SECTION 3. The last day for receipt of primary arguments for or against the measure has been established as 5: 00 P.M. on August b, 1991, in the City Clerk ' s Office, City Hall, 30 Cajon Street, Redlands, California and signed by each author of the argument in conformance with provisions of Section 5350 of the Elections Code. Arguments may be changed or withdrawn until and including this date fixed by the City Clerk . SECTION 4. The last day for receipt of rebuttal arguments has been established at 5: 00 P .M. on August 13, 1991, in the City Clerk ' s Office at the above location and must be accompanied by a form obtained from the City Clerk ' s Office and signed by each author of the rebuttal in conformance with the provisions of Section 5350 of the Elections Code. Rebuttals may be changed or withdrawn until and including this date fixed by the City Clerk . SECTION 5. The ballots to be used at said election shall be in form and content as required by law. SECTION b. The City Clerk of the City of Redlands is hereby authorized, instructed, and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 7. The polis for said election shall be open at 7: 00 A.M. of the day of said election and shall remain open continuously from said time until 8: 00 P.M. of the same day when said polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 8. In all particulars not recites: in this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said City. SECTION 9. Notice of the time and holding of said election is hereby given and the City Clerk is hereby authorized, instructed, and directed to give such further or additional notice of said election, in time, form, and manner as required by law. SECTION 10. Pursuant to the requirements of Section 23302 of the Elections Code, the Board of Supervisors of the County of San Bernardino is hereby requested to consent and agree to the consolidation of said special municipal election with the County of San Bernardino election to be held on said date, and within the City the precincts and polling places for the special municipal election shall be the same as those provided for said County of San Bernardino. That the Board of Supervisors of the County is hereby requested to issue instructions to the Registrar of Voters to take any and all steps necessary for the consolidation of the special municipal election with said County election, and that the County of San Bernardino Registrar of Voters is authorized to canvass the returns of the special municipal election. The special municipal election shall be held in all respects as it there were only one election and the Board of Supervisors shall certify the results of the canvass of the returns to the City Council. SECTION 11. The City of Redlands recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reirrburse the County for any such costs. SECTION 12. Pursuant to Section 20501 (b) of the Elections Code of the State of California, if any two or more persons receive an equal and the highest number of votes for an office to be voted for within the City, there shall be held within the City a Special Runoff Election to resolve the tie vote. A Special Runoff Election shall be called and held on a Tuesday not less than 40 nor more than 125 days after the administrative or judicial certification of the election which resulted in a tie vote. i i SECTION 13. The City Clerk of the City of Redlands is hereby directed to file a certified copy of this Resolution with the Board of Supervisors and the Registrar of Voters of the County of San Bernardino.
