HomeMy WebLinkAbout4605_CCv0001.pdf RESOLUTION NO. 4605 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS PROVIDING FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF THE CITY OF REDLANDS OF AN INITIATIVE ORDINANCE RELATING TO A UTILITY USERS TAX, CALLING AND GIVING NOTICE OF A SPECIAL MUNI- CIPAL ELECTION THEREFOR, AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN BERNARDINO TO CONSOLIDATE SAID ELECTION WITH THE STATEWIDE DIRECT PRIMARY ELECTION TO BE HELD ON TUESDAY, JUNE 5, 1990 WHEREAS, the City Council of the City of Redlands, California ( the "City Council" ) desires to submit to the qualified voters of the City an initiative ordinance relat- ing to a Utility Users Tax; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS does hereby resolve as follows: SECTION 1 . Pursuant to the requirements of the laws of the State of California relating to general law cities within said State, there shall be, and there is hereby called and ordered a special municipal election to be held in the City of Redlands, California, on Tuesday, June 5, 1990 . SECTION 2. That on the ballots to be used at said special municipal election, in addition to any other matters required by law, there shall be printed substantially the following: Shall Ordinance No. 2111 be adopted to levy a utility users tax on the citizens of Redlands in an amount not to exceed four percent ( 0 ) , and with exemptions for seniors and low income persons, to: ( 1) establish an anti-gang/drug task Yes force, enhance its D.A.R.E. program, and purchase earthquake and disaster pre- paredness equipment ; ( 2) expand paramedic services; ( 3 ) fund other emergency and public safety related services ; and ( 4) maintain competitive salaries, based upon a survey of sur- rounding communities, to attract and No retain highly qualified public safety personnel; and shall the City' s appropriation limit be increased by the amount of revenue derived from the paid tax? The measure submitted to the voters by this Resolu- tion shall be designated on the ballot by a letter printed on the left margin of the square containing the description of this initiative ordinance, as provided in Section 10219 of the Elections Code. SECTION 3 . A cross ( +) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the initiative ordinance. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the initiative ordinance. The question shall be adopted only upon affirmative vote of two-thirds ( 2/3 ' s) of the votes cast upon the question. SECTION 4. The last day for receipt of primary arguments for or against the initiative ordinance is 5 : 00 P.M. on March 6, 1990, in the City Clerk ' s Office, City Hall, 30 Cajon Street, Redlands, California. Written arguments shall not exceed 300 words in length and must be accompanied by a form obtained from the City Clerk ' s Office and signed by each author of the argument in conformance with provisions of Section 5350 of the Elections Code. Arguments may be changed or withdrawn until and including the above date. SECTION 5 . The last day for receipt of rebuttal arguments is 5 : 00 P.M. on March 13 , 1990, in the City -2- Clerk ' s Office at the above location. Written rebuttals shall not exceed 250 words in length and must be accompanied by a form obtained from the City Clerk ' s Office and signed by each author of the rebuttal in conformance with the provisions of Section 5350 of the Elections Code. Rebuttals may be changed or withdrawn until and including the above date. SECTION 6 . The City Clerk of the City of Redlands is hereby authorized, instructed and directed to procure and furnish any and all official ballots , notices , printed mat- ter and all supplied, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 7 . The polls for the election shall be open at 7 : 00 A.M. of the day of the election and shall remain open continuously until 8 : 00 F.M. of the same day when the polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California . SECTION 8. In all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for holding municipal elections in the City. SECTION 9 . That notice of the time and place of holding the special municipal election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of the election, in time, form and manner as required by law. SECTION 10. Pursuant to the requirements of Sec- tion 23302 of the Elections Code, the Board of Supervisors of the County of San Bernardino is hereby requested to con- sent and agree to the consolidation of said special elec- tion to be held on said date, and within the City the precincts and polling places for the special municipal shall be the same as those provided for the County of San Bernar- dino. That the Board of Supervisors of the County is hereby requested to issue instructions to the Registrar of Voters to take any and all steps necessary for the consolidation of this special municipal election with the County election, and that the County of San Bernardino Registrar of Voters is authorized to canvass the returns of the special municipal election. The special municipal election shall be held in all respects as if there were only one election and the Board of Supervisors shall certify the results of the can- vass of the returns to the City Council . -3- SECTION 11 . The City Council of the City of Redlands recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for any such costs. SECTION 12. The City Clerk of the City of Redlands is hereby directed to file a certified copy of this Resolu- tion with the Board of Supervisors and the Registrar of Voters of the County of San Bernardino.
