HomeMy WebLinkAbout3771_CCv0001.pdf RESOLUTION NO. 3771 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLA.NDS DECLARING THAT THE ADOPTION OF CERTAIN CHANGES AND MODIFICATIONS TO THE STATE BUILDING STANDARDS CODE RELATING TO THE STANDARDS OF AVAILABILITY OF THE PUBLIC SEWER IS DETERMINED NECESSARY FOR THE PRESERVATION OF PUBLIC HEALTH AND WELFARE, AND FURTHER THAT SUCH CHANGES AND MODIFICATIONS ARE JUSTIFIED BY LOCAL CLIMATIC, GEOGRAPHIC AND TOPOGRAPHIC CONDITIONS WHEREAS, the City Council of the City of Redlands had enacted Ordi- nance No. 1729, which provides in Section 84105 thereof that Section 1101 (d) of the Uniform Plumbing Code shall be amended to provide that a public sewer is considered to be unavailable when such sewer is located more than one hundred (.100) feet from the nearest point of the property to such public sewer; and WHEREAS, the standards set forth in Section 84105 of Ordinance No . 1729 are more restrictive than those set forth in the Uniform Plumbing Code; and WHEREAS, Health and Safety Code Section 17958 .7 requires this City Council to :Hake an express finding that such amendment of the State Building Standards Code as set forth in the Uniform Plumbing Code is necessary because of local climatic, geographical or topographical conditions; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS does hereby find, determine and resolve as follows : SECTION ONE: For many years, nitrate fertilizers have been used by the citrus and agricultural industry in the City of Redlands to enrich the soils . As a result, high concentrations of nitrates in the local ground water basin have created a water quality problem which necessi- tates the utilization of every practical method to preserve further degradation of ground water resources. Local climatic, geographical and topographical conditions render it necessary to protect against further degradation of the ground water by requiring proper treatment of sewage effluent at municipal treatment plant facilities wherever possible. Section 84105 of Ordinance No. 1729 of the City of Redlands protects against further degradation of the local ground water by modi- fying Section 1101 (d) of the Uniform Plumbing Code to impose more strin- gent requirements upon mandatory connections to public sewers within the City. SECTION TWO: The City Clerk of the City of Redlands is hereby directed to send this express finding of need to the Department of Housing and Community Development pursuant to Health and Safety Code Section 17958 . 7 and to keep such finding available as a public record for the City of Redlands .
