RESOLUTION NO. 4830 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ORDERING THE WORK IN CONNECTION WITH ANNEXATION NO. 4 TO STREET LIGHTING DISTRICT NO. 1 WHEREAS, the City Council of the City of Redlands did on the 21st day of January, 1992 , adopt its Resolution of Intention No. 4829 to order the therein described work in connection with the Annexation No . 4 to Street Lighting District No. 1 , which Resolution of Intention No. 4829 was duly and legally published at the times, and in the form and manner as required by law, shown by the affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Public Notice, " was duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing said Notice, on file in the office of the City Clerk; and WHEREAS, said City Council having duly received and considered evidence, oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contem- plated work and the benefits to be derived therefrom; and WHEREAS, said City Council has determined that a majority protest does not exist; and WHEREAS, said City Council having now acquired jurisdiction to order the proposed work; SECTION 1. It is hereby resolved by the City Council of the City of Redlands that the public interest and convenience requires Annexation No. 4 to the district and the ordering of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 4829, be done and made; and SECTION 2 . In the letter I recount several items of work that must be undertaken by the city staff. Included -in the letter is the information regarding the distribution of copies of the report for the January 7, 1992 City Council meeting. Please review the letter and if you have any questions regarding these suggested procedures, please feel free to contact me. Please note that the four resolutions included in the Engineer's Report have the numbers inserted in them. These resolution numbers were given to my staff by you on December 10, 1991. The third resolution in the booklet is the City Council's resolution of intention of' holding a public hearing to consider any public comments regarding the annexation into the street lighting district. This resolution must be published once at least ten days prior to January 21, 1992, which is the date for the public hearing. This involves boundaries of MS 213 , MS 211, CUP 559, CRA 636, CRA 546, CRA 641, CRA 6401 CUP 562, and CUP 548. The originals of the Assessment Diagram are included and should be delivered to, and filed with, the City Clerk. The copies of the booklet should be distributed for the January 7 , 1992 , Council meeting. Included in the booklet are four resolutions and the Engineer's Report. For your information I will summarize the contents of the booklet and suggest procedures to be followed which will result in the formation of the district. 1. The Engineer's Report outlines the improvements which will be installed and estimates the dollar value required for the maintenance of the improvements and incidental expenses through the end of the 1992-93 Fiscal Year. 2 . The first resolution appoints Engineer of Work for the district and orders the preparation of the Engineer's Report. The second resolution gives preliminary approval of the Engineer's Report. The third resolution is the Council 's declaration of intention of ordering the annexa- tion to Street Lighting District No. 1, specifying the boundaries of the district, and setting January 21, 1992 as the date for the public hearing to consider the formation. The first three resolutions in the booklet should be adopted by the City Council at their January 7 , 1992 , meeting, and should be consent calendar items. I am also including an Affidavit of Posting of Notice of Improvement which will be required to be executed by Joe Hopper as the Street Services Engineer certifying that he has posted the property in compliance with the order of the City Council. The Notice of Improvement should be posted at intervals of not more than 300 feet along the streets within and surrounding the proposed assessment district. 4 . Following the City Council's adoption of the third resolu- tion of the booklet (Resolution of Intention) , an executed copy should be mailed by the City Clerk to all the owners of record on the attached listing. The City Clerk should certify the mailing of the copy of the resolution to each of the listed owners. 5 . The last resolution within the booklet is a resolution which will be adopted following the public hearing on January 21, 1992 . It either approves or modifies and approves the Engineer's Report, and confirms the assessments. 6. Following the public hearing on January 21, 1992 , the City Clerk should obtain the signatures on the original mylars of the Assessment Diagram and retain the map in her files.
