HomeMy WebLinkAbout4877_CCv0001.pdf RESOLUTION NO. 4877 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ORDERING THE CONTINUED OPERATION OF STREET LIGHTING DISTRICT NUMBER 1 AND CONFIRMING THE ENGINEER'S REPORT AND ASSESSMENT FOR 1992-93 FISCAL YEAR WHEREAS, the City Council of the City of Redlands did on the 2nd day of June, 1992 , adopt its Resolution of Intention No. 4876 to order the therein described work in connection with the continuation of assessment procedures in Street Lighting District No. 1, which Resolution of Intention No. 4876 was duly and legally published in the time, form and manner as required by Law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS, said. City Council having duly received and considered evidence, oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contem- plated work and the benefits to be derived therefrom; and WHEREAS, said City Council has determined that a majority protest does not exist; and WHEREAS, said City Council having now acquired jurisdiction to order the proposed work; SECTION 1. It is hereby resolved by the City Council of the City of Redlands that the public interest and convenience requires the continuation of assessment procedures for the district, and said City Council hereby orders that the work and assessment, as set forth and described in said Resolution of Intention No. 4876, be done and made; and SECTION 2 . Be it finally resolved that the assessments for Fiscal year 1992-93 and method of assessment in the Engineer's Report are approved and levied. The addendum was prepared as directed by the City Council at their May 19 meeting. Also enclosed are unbound copies of the Addendum and Resolutions No. 4875, 4876 and 4877. The first two resolutions should be presented to the City Council for their consideration on June 2 . Resolution No. 4876 calls for a public hearing and sets the date as July 7 . Following the public hearing on July 7 , Resolution No. 4877 should be adopted which will either approve, or modify and approve and levy the assessments for the 1992-93 Fiscal Year. McGrew Principal Planner City of Redlands Post Office Box 3005 Redlands, California 92373 Reference: Addendum No. 1 to 1991-9.3 Engineer's Report for Street Listing District No. 1 Dear Ms. McGrew: Enclosed are 17 copies of the amended 1992-93 Engineer's Report for Street Lighting District No. 1 in the City of Redlands. The 17 copies of the booklet are for delivery to the City Clerk for distribution for the June 2 Council meeting. Resolutions have been delivered to the City Clerk with the dates changed for the June 2 and July 7 meeting. I understand that July 7 will be the date scheduled for the public hearing to consider levying the assessments for the cording fiscal year. The addendum addresses the items on which the City Council had concern. All properties located within Annexations 1, 2 , 3 and 4 were field reviewed to determine whether on-site development had been completed or whether the project had received final develop- ment approval . Assessments are proposed to be levied only on those properties which have had the projects completed or in the case of two subdivisions, which are well along with the completion process.. The addendum also addresses the proration of the cost of the incidental costs between the Original District formation and the various annexations on a unit of benefit basis. The recommended Council action for the June 2 meeting would be to adopt Resolutions No. 4875 and 4876. Resolution 4876 is the Council's resolution of intention of holding the public hearing on July 7 . Ms. Paula McGrew - 2 - May 26, 1992 Resolution 4877 would be adopted following the public hearing on - July 7. This resolution either approves or modifies and approves the Engineer's Reports and levies the assessments. Sincerely, Noel L.
