HomeMy WebLinkAbout5064_CCv0001.pdf RESOLUTION NO. 5064 THE RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, DECLARING ITS INTENTION TO ORDER AN ANNEXATION TO STREET LIGHTING DISTRICT NO. 1, AN ASSESSMENT DISTRICT; DECLARING THE WORK TO BE OF MORE LOCAL THAN ORDINARY PUBLIC BENEFIT; SPECIFYING THE EXTERIOR BOUNDARIES OF THE AREA TO BECOME ANNEXATION NO. 7 TO STREET LIGHTING DISTRICT NO. 1 AND TO BE ASSESSED THE COST AND EXPENSE THEREOF; DESIGNATING SAID ANNEXATION AS ANNEXATION NO. 7 TO STREET LIGHTING PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO, MS 228, CRA 639, CUP 602, CUP 590, CUP 607, CUP 577, CUP 541 AND TR 15790-1 The City Council of the City of Redlands, pursuant to the provisions of The Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California, does resolve as follows: Description of Work SECTION 1. That the public interest and convenience requires and it is the intention of the City Council of the City of Redlands, California, to order the following work to be done, to wit: 1. Maintenance, operation and servicing of street lighting facilities as authorized by Section 22525 of the Streets and Highways Code. 2. Any and all work and materials appurtenant thereto or which are necessary or convenient for the maintenance, operation and servicing thereof. Location of Work SECTION 2. The foregoing described work is to be located within roadway right-of-way and public easements within the boundary of MS 228, CRA 639, CUP 602, CUP 590, CUP 607, CUP 577, CUP 541 and TR 14790-1 in the City of Redlands, California. Description of Assessment District SECTION 3. That the contemplated work, in the opinion of said City Council, is of more local than ordinary public benefit, and said City Council hereby makes the expense of said work chargeable upon a District, which said District is assessed to pay the costs and expenses thereof. 5. Report of the Engineer SECTION 4. The City Council of said City by Resolution No. 5063 has preliminarily approved the report of the assessment engineer which report indicates the amount of the proposed assessment, the district boundary, assessment zones, detailed description of improvements, and the method of assessment. The report titled "City of Redlands, California, Engineer's Report for Annexation No. 7 to Street Lighting District No. 1" is on file in the office of the City Clerk of said City. Reference to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the work. Collection of Assessments SECTION 5. The assessment shall be collected at the same time and in the same manner as County taxes are collected. The Assessment Engineer shall file a report annually with the City Council of said City. Said Council will annually conduct a public meeting and public hearing upon said report at which time assessments for the next fiscal year will be determined. Time and Place of Hearing SECTION 6. Notice is hereby given that on the 21st day of June, 1994, at the hour of 7:00 p.m. in the City Council Chambers at 212 Brookside Avenue, in the City of Redlands, California, any and all persons having any objections to the work or extent of the assessment district, may appear and show cause why said work should not be done or carried out or why said district should not be formed in accordance with this Resolution of Intention. The City Council will consider all oral and written protests. The Landscaping and Lighting Act of 1972 SECTION 7. All the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California designated The Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California. Exclusion of Public Property SECTION 8. All lots or parcels belonging to public agencies shall be omitted from assessments to be made hereafter to cover the costs and expenses of the work. 6. Mailing of Notice of Improvement SECTION 9. The City Clerk of the City shall cause notice of the protest hearing to be mailed to all property owners within the proposed annexation to the district in accordance with Section 22556 of the Streets and Highways Code. Said notice shall be mailed to all persons on the latest equalized tax roll of the County of San Bernardino not less than 45 days prior to the date of the hearing. Certification SECTION 11. The City Clerk shall certify as to the adoption of this Resolution.
