A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
CONFIRMING SOLID WASTE RATES AND CEASING TRANSFERS OF
SOLID WASTE RATE REVENUES TO THE PARIS PROGRAM
WHEREAS, the City of Redlands provides solid waste utility service for its residents;
and
WHEREAS, the City last adjusted its rates for solid waste service in September 2024,
based on recommendations from R3 Consulting Group, Inc. (R3), regarding the City's costs for
this service; and
WHEREAS, the rates the City adopted in September 2024 included three cost
assumptions relevant to this Resolution: (1) an annual transfer out of the Solid Waste Enterprise
Fund to support the City's Pavement Accelerated Repair Implementation Strategy (PARIS),
(2) a solid waste vehicle replacement schedule that required vehicles to stay in service beyond
normal expectations for their useful lifetimes, and (3) no funding in Fiscal Years 2024-2025
through 2027-2028 to purchase zero emission vehicles (ZEVs) as required by Advanced Clean
Fleets regulations from the California Air Resources Board; and
WHEREAS, the California Court of Appeal has ordered the City to cease imposing solid
waste rates that include a charge to fund the PARIS transfer (Rogers v. City of Redlands, Case
No. G063580); and
WHEREAS, the City Council intends by this Resolution to fully comply with the Court's
order; and
WHEREAS, the City engaged R3 again, this time to recommend rate adjustments that
both eliminate the PARIS transfer and still recover all valid costs of solid waste utility service,
including a reasonable vehicle replacement schedule that includes purchasing ZEVs in the near
term; and
WHEREAS, R3 provided these recommendations in its "2025 Update to 2024 Solid
Waste Financial Plan & Rate Study," dated September 12, 2025 (the 2025 Rate Study Update);
and
WHEREAS, the City Council has reviewed the 2025 Rate Study Update, which
recommends maintaining the City's current solid waste rates to cover costs that exclude the
PARIS transfer but include an updated vehicle replacement plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF REDLANDS AS FOLLOWS:
Section 1. The foregoing recitals are true and correct and are hereby incorporated into
this Resolution by this reference.

Section 2. The City Council hereby accepts and approves the 2025 Rate Study Update
submitted by R3.
Section 3. The City Council hereby confirms that its charges for solid waste service shall
remain unchanged from the rate schedule the Council approved through Resolution No. 8627 on
September 3, 2024. As the Council does not order any change to these rates, this Resolution does
not impose an "increase" in those rates. (Gov. Code, § 53750(h).) Nonetheless, the Council finds
that the City's solid waste rates, as confirmed by this Resolution and as implemented in accord
with the 2025 Rate Study Update, meet all of the requirements in Article XIII D, section 6(b) of
the California Constitution.
Section 4. The City Council orders the City Manager, the Director of the Municipal
Utilities & Engineering Department, and all other relevant City officials to ensure that, beginning
with FY 2025-2026, solid waste rates and charges no longer include any amount to fund the
PARIS program or any similar street repair program.
Section 5. This Resolution is not subject to the California Environmental Quality Act
(Pub. Resources Code, § 21000 et seq.) pursuant to Public Resources Code, section 21080(b)(8),
and California Code of Regulations, title 14, sections 15061(b)(3) and 15273.
Section 6. If any portion of this Resolution, including but not limited to any particular
rate or charge adopted hereby, is held to be unconstitutional, invalid, or otherwise unenforceable
by a court of competent jurisdiction, that holding shall not affect any other portion of this
Resolution.
Section 7. This Resolution shall become effective immediately upon its approval.
