HomeMy WebLinkAbout8729RESOLUTION NO. 8729 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS AUTHORIZING THE CITY MANAGER TO APPROVE CERTAIN WORKERS' COMPENSATION PAYMENTS AND SETTLEMENTS WHEREAS, the City's existing policies are silent on the process and authority for approving medical and workers' compensation settlement payments; and WHEREAS, certain workers' compensation claims that are accepted require the payment of medical bills in order to provide necessary and reasonable medical treatment to injured employees; and WHEREAS, certain workers' compensation claims are resolved by way of stipulated settlements, whereby the City and the claimant agree to the resolution of specific issues within the claim, and payments are required to be made under such stipulated settlements; and WHEREAS, certain workers' compensation claims are resolved by compromise and release, whereby the City and the claimant agree to a full and final settlement of the claim, and certain payments are required to be made under such compromise and release agreements; and WHEREAS, these payments are required by law and must be made in accordance with statutory or regulatory obligations, with no discretion exercised by the City; and WHEREAS, the authority granted by this Resolution is intended to ensure timely compliance with legal obligations and does not extend to discretionary settlements or payments beyond this specific category. NOW, THERFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS; Section 1. The Redlands City Council hereby authorizes the City Manager, with the approval of the City Attorney, to approve the following workers' compensation payments and settlements, up to an amount not to exceed Fifty Thousand Dollars ($50,000): a) Payment of medical bills for accepted workers' compensation claims; b) Payments required pursuant to stipulated settlements of workers' compensation claims; and c) Payments required pursuant to compromise and release agreements related to workers' compensation claims. 1• 1:\cmo\Reso1utions\6420-Ce11ain Workers' Compensation Paymmts and Settlements.doc-jl Section 2. All prior workers' compensation medical payments, required payments pursuant to stipulated settlement, and pursuant to compromise and release are hereby ratified and confirmed. Section 3. This Resolution shall take effect immediately upon its adoption.
