HomeMy WebLinkAbout5467_CCv0001.pdf RESOLUTION NO. 5467 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, COUNTY OF SAN BERNARDINO, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE FORMATION OF STREET LIGHTING DISTRICT NO. 2, AN ASSESSMENT DISTRICT DECLARING THE WORK TO BE OF MORE SPECIFIC THAN GENERAL PUBLIC BENEFIT; SPECIFYING THE EXTERIOR BOUNDARIES OF THE AREAS TO BE FORMED AS STREET LIGHTING DISTRICT NO. 2 AND TO BE ASSESSED COST AND EXPENSES THEREOF; AND DETERMINING THAT THESE PROCEEDINGS SHALL BE TAKEN PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND ARTICLE XIIID OF THE CALIFORNIA CONSTITUTION; AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO The City Council of the City of Redlands, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California and in compliance with Article XIIID of the California Constitution, does resolve as follows: DESCRIPTION OF WORK SECTION I. That the public interest, convenience and necessity requires and it is the intention of the City Council of the City of Redlands, California, to order the following work be done, to wit: 1. Maintenance, operation and servicing of street lighting as authorized by Section 22525 of the Streets and Highways Code. 2. Any and all work and materials appurtenant thereto or which are necessary or convenient for the maintenance and servicing thereof. LOCATION OF WORK SECTION 2. The foregoing described work is to be located within the street right-of-way and public utility easements at certain locations within the incorporated boundaries of the City of Redlands, more particularly described on maps which are on file in the Office of the City Clerk entitled "Street Lighting District No. 2". DESCRIPTION OF ASSESSMENT DISTRICT SECTION 3. That the contemplated work, in the opinion of said City Council, is more specific than general public benefit, and the said City Council hereby makes the expense of the said work chargeable upon a district, which said district is assessed to pay the costs and expenses thereof, and which district is described as follows: All those certain territories of the City of Redlands indicated within the exterior boundary line shown upon certain "Proposed Boundary Map Street Lighting District No. 2,"heretofore approved by the City Council of said City by Resolution No. 5466 indicating by said boundary line the extent of the territory included within the proposed assessment district and which map is on file in the Office of the City Clerk of said City. Reference is hereby made to said map for further, full and more particular description of said assessment district, and the said maps so on file shall govern for all details as to the extent of said assessment district. REPORT OF THE ENGINEER SECTION 4. The City Council of said City by Resolution No. 5466 has preliminarily approved the report of the Assessment Engineer which indicates the amount of the proposed assessment, the district boundary, detailed description of improvements and the method of assessment. The report entitled "Engineer's Report for Street Lighting District No. 21998-99 Fiscal Year", is on file in the Office of the City Clerk of said City. Reference to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the work. COLLECTION OF ASSESSMENTS SECTION 5. The assessments shall be collected at the time and in the same manner as County taxes are collected. The Assessment Engineer shall file a report annually with the City Council of said City and said Council will annually conduct a public meeting and public hearing upon said report at which time assessments for the next fiscal year will be determined. TIME AND PLACE OF HEARING SECTION 6. Notice is hereby given that on the 5th day of May, 1998 for a public meeting and the 7th day of July, 1998 for a public hearing at the hour of 7:00 p.m. in the City Council Chambers at 35 Cajon Street, Suite 2, in the City of Redlands, any and all persons having any objections to the work or extent of the assessment district may appear and show cause why said work should not be done or carried out in accordance with this Resolution of Intention. The City Council will consider all oral and written protests. Ballots shall be tabulated at the public hearing to determine if a majority protest to the Assessment District exists. LANDSCAPING AND LIGHTING ACT OF 1972 SECTION 7. All the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California designated the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California and in compliance with Article XIIID of the California Constitution. MAILING OF NOTICE AND BALLOT SECTION 8. The City Clerk is directed to mail notices and ballot of the adoption of this resolution of intention to all persons owning real property proposed to be assessed in these proceedings, whose names and addresses appear in the last equalized assessment roll for taxes, and in the manner and form provided for under Section 22556 of the said Landscaping and Lighting Act of 1972 of said Streets and Highways Code. A ballot shall be mailed with the notice in conformance with Article XIIID of the California Constitution. CERTIFICATION SECTION 9. The City Clerk shall certify to the adoption of this Resolution.
