RESOLUTION NO. 7044 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS GIVING PRELIMINARY APPROVAL OF THE ENGINEER'S REPORT FOR FISCAL YEAR 011- 2012 FOR STREET LIGHTING DISTRICT NO. I WHEREAS, the City Council of the City of Redlands ("this City Council") has heretofore determined that the public interest, convenience and necessity require the maintenance and operation of street lighting and appurtenant facilities, as set forth in Section 22525 of the Streets and Highways Code, within the, incorporated boundaries of the City of Redlands; and WHEREAS, Rosemary Hoerning, City of Redlands, City Engineer 35 Cajon Street, Suite 15A. Redlands, California, has been appointed "Assessment Engineer" with all provisions of Part 2 of Division 15 of the Streets and Highways Code applicable to the Engineer being applied to the"Assessment Engineer;" and WHEREAS, Sections 22622 and 22623 of the Streets and Highways Code require that an Engineer's Report be prepared and filed annually, specifying the assessments to be levied against the benefitting properties within the City's Street Lighting District No. 1; and WfIEREAS, the City of Redlands' City Engineer, as the Assessment Engineer, has prepared and filed with the City Clerk a report in writing as required by the Landscaping and Lighting Act of 1972 and in compliance with Article XIIID of the California Constitution; and WHEREAS, this City Council has duly considered said report and each and every part thereof-, and finds that each and every part of said report is sufficient, and that no part of said report requires modification in any respect; NOW, THEREFORE, be it resolved by the City Council of the City of Redlands as follows: Section 1. That the Engineer's estimate of the iterniz..ed costs and expenses of said work and of the incidental expenses in connection therewith, contained in said report be, and each of them are hereby, preliminarily approved and confirmed. Section 2. That the diagram showing the Street Lighting District No. I referred to and described in said report, and the, boundaries of the lots and parcels of land within such assessment district as the same existed at the time of passage of this resolution, are here-by preliminarily approved and confirmed. Section 3. That the proposed assessment upon the, properties in Street Lighting District No. 1, in proportion to the estimated benefit to be received by such properties, respectively, from said work and of the incidental expenses thereof, as contained in said report is hereby preliminarily approved and confirmed. Section 4. That said report shall stand as the, Engineer's Report for the purposes of all subsequent proceedings for Street Lighting District No. 1. District. The boundaries of said District and annexations thereto are entitled `"Assessment Diagram of Street Lighting district No,, I,", and are on file in the office of the City Clerk of the City of Redlands, III. PLANS AND SPECIFICATIONS All street lights are or will be owned by the City and are provided electrical services by Southern California Edison Company (SCE). Reference is hereby made to the subject tract or parcel maps and assessment diagrams for the exact location of the parcels covered by the District. The plans and specifications by reference are hereby made a part of this report to the lanae extent as if said plans and specifications were attached hereto.. IV. IMPROVEMENTS The. Landscaping and Lighting Act of 1972 allows the confirmation of benefit assessments for the construction of improvements in addition to maintenance and operation of"existing facilities. Assessments will not be levied under the District to fund the installation of street lights during I Y2011-2tf 12, Therefore, this report does not include any proposed benefit assessments for the installation of improvements for p '?tf 11 201?;. V. ASSESSMENT DIAGRAM The assessment District locations for the Original District and subsequent Annexations shown as Appendix B thereto have been prepared. The assessment diagrams by reference are hereby made a part of this report. Since there were numerous locations as part of Annexation Nos, 1, ?, 3, 4, 5, etc. they were identified on the diagram as S 1-A, S 1-B, S I-C:" or S?-A, S2-13, S_-C. etc. Prefix, S i added to the identification on the later Annexations to identify that they are within the:: District. ESTIMATED COSTS AND MAINTENANCE Since the City owns the street lighting system, all maintenance efforts by the City should be allocated to the, District as a direct cost. The Municipal utilities and Engineering Department has taken the information used in the previous annual report and updated the values based upon the forn-alas for Unit of Benefit. Southern California Edison (SCE) monthly rates were calculated lased upon LS-2 schedule of rates 1€r l()OW and 150W high pressure sodium vapor street lights. Because the District costs have historically° exceeded the revenue generated by District assessment, it is anticipated that minimal administration and no Maintenance will be provide during the 2011-12 year. As such, the labor- amount has been significantly reduced:to an estimated value of S2,500 to be spread equally over the number of street lights. Over the years, the existing assessments have not kept pace with the true annual cast of maintenance and administration. As a result, at the end of F5'``0 1-201 there will be a fund deficit. As a result of the downturn in the economy the: City is no longer able to use general funds to subsidize the Street Lighting l l intenance District. As such, the City will be reducing District expenses to a level commensurate with the revenue generated by the assessments, To reduce the expenses associated with the street lighting operations nig maintenance/repair will, be performed during the Y201 l-1? year. The basic assessment will be for power, assessed in accordance with the Unit of Benefit (LiOB) formulas established at District inception. Eligible expenses which have not been included in the District cost include overhead and incidentals, However,clue to the financial condition of the District they were not presented as expenses. Given the ;anticipated curtailed operations schedule, it is expected that the District will Mill maintain a deficit condition. For FY2011-12 it is anticipated the additional funds in the amount of S3,697.00 may b required to cover a District deficit during this period. No new areas are beim proposed to be annexed to the District for F 201 1-? )12:. VII ASSESSMENT ROLL Following the public hearing for FY2011-201 ; assessments and the City Council's approval of the assessments, an assessment roll will be prepared. The assessment roll will, include the assessment parcel number, the San Bernardino County assessor's parcel number and the confiraaaed assessment for each parcel. The assessment roll will be filed with the City Clerk and will subsequently be transmitted to the:. San Bernardino County Auditor/Tax Collector: `III. PROPOSED BASIS FOR ASSESSMENTS The City Council has heretofore determined that it will be necessary to utilize the provisions of.the landscaping and L,i titin pct of 1972, a benefit assessment act., for the Original District and the subsequent Annexations to the District, and to assess benefitting properties in proportion to the benefits that the various properties will receive. The benefits the properties will receive will be assessed as increments of units of benefit (U013). The District and the subsequent Annexations consist of various types of development;having varying parcel sizes. Since the street lights either have been or will be installed in accordance with customary spacing established by the City, there will be four Assessment Zones based upon a street's curb-to-curb width, Assessments proposed for individual parcels within the:. District and Annexations will be for the benefit received and will be determined based upon the four following Assessment nt Zones. Zone 2: This will include all parcels having frontage on streets with curl separations of less than 40' with 100 watt HP VL at 60W spacing. Zone: This will include all parcels having frontage on streets with curb separations of 0' or greater and less than 64' with 150 watt 11P aVL at 250' spacing. ;Lane 4: This will include all parcels having frontage on streets with curb separations of 64' or more with 150 watt HPSVL at 230' spacing. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RECILANDS CONFIRMING A DIAGRAM AND ASSESSMENT FOR THE 201 t-21112 FISCAL YEAR IN CONNECTION WITH STREET LIGHTING DISTRICT NO. 1 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, PART 2 OF DIVISION 15 OF THE CALIFORNIA S'T'REETS AND HIGHWAYS CODE 6L IT RESOLVED IIT THE CITE' COUNCIL OF THE CITY OF REDLA;'tiDS A Section 1, pursuant to prior resolution, the City Council of the City of Redlands initiated proceedings and declared its intention to levy an assessment against the assessable lots and parcels of property within an existing assessment district designated "Street Lighting District No P (the District) pursuant to the provisions of the Landscaping and Lighting Act of 1972, fart 2 of:Division 15 of the California Streets and Highways Code (commencing with Section 22500 (the"Act") for the fiscal year commencing July 1, 2011, and ending.lune 30, 2012, and order the Engineer,,Rosemary Hoerning, to prepare and file a written report: in accordance with Article of Chapter l of the Act. The City Council,by prior resolution, approv=ed such Engineer's Report.- Section 2. Following notice duly given in accordance with law. the City° Council has held a full and fair public hearing regarding the Engineer's Report and the levy and collection of the proposed assessment within the Districtfor fiscal year 2011-20122 to pay for the costs and expenses of the improvements described in the Engineer's Report pursuant to the terns and provisions of the Act. All interested persons were afforded the opportunity to hear and be heard regarding protests and objections to the. levy and collection of the proposed assessment against lots or parcels of property within the. District. The City Council considered all oral and written statements, protests and communications made or filed by interested persons. Section 3. Based upon its review of the Engineer's Report and other reports< and information, the City Council hereby finds and determines that (i) the land within the District' will be benefited by the improvements described in the Engineer's Report (ii) the District includes all of the lands so benefited, and (iii) the net amount it,) be assessed upon the lands with the District for the 2011-2012 fiscal year in accordance with the Engineer's Report is apportioned by a formula and method which fairy distributes the net amount arnong all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements. Any and all oral and written protests and objections are hereby overruled by the City Council. Section 4. The City Council declares that the diagrarri and assessment in theEngineer's Report are hereby confirmed as filed; Section 5. They City Council hereby orders the improvements described in the. Engineer's Report to be mad Section 6. The assessment is in compliance with the provisions of the Act and the City Council has compiled with all law pertaining to the levy of an annual assessment pursuant to the Act. Section 7. The assessments to be levied and collected against the assessable lots and parcels of property within the District for fiscal year 2011-2012 are not proposed to increase trom the assessment levied and collected for fiscal year 1997-1998. Section S. The assessment is levied without regard to property valuation. Section 9. Public property owned by any public agency and in use in the performance of a public function which is included within the boundaries of the District shall not be subject to assessment to be made under these proceedings to pay for any of the costs and expenses of the improvements. Section IIOV. The assessment is levied for the purpose of paying the costs and expenses of the improvements described in the Engineer's Report for fiscal year 2011-2012 Section 11. The improvements described in the Engineer's Report shall be perforin-red pursuant to law. Section 1? The County Auditor of San Bernardino County shall enter on the County Assessment Roll opposite each lot or parcel of land the amount of the assessment and such assessments shall then be collected at the same tit-ne and in the same manner as the County taxes collected. After collection by the County, tire net amount of the assessments shall be paid to the City Treasurer. Section 13. The City Treasurer shall deposit all inoncys representing assessments collected by the County to the credit of a special fund for Street Lighting District No. 1. Section 14. The adoption of this Resolution constitutes the levy of an assessment against the lots and parcels of land in the District for the fiscal year commencing July L 2011 and June 30, 2012, Section 15. The City Clerk- is hereby authorized and directed to file the dia , gram and Ir assessment, or a cert led copy of the, diagram and assessment, with the County Auditor, together with a certified copy of this Resolution upon its adoption. Section 116.
