BOX 3005 PAID $0.00 REDLANDS, CA 92373 FI FS NOT REQUIRED PER OOVERNMENT CODE SECTION 6103 THIS SPACE FOR RECORDER'S USE ONLY (AFFECTS ASSESSOR'S PARCEL NOS. 0292-44-09, 10, 11 and 12) RESOLUTION NO. 7145 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT A PORTION OF PALMETTO AVENUE IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF A PORTION OF PALMETTO AVENUE (CITY OF REDLANDS STREET VACATION NO. 156) (A PORTION OF ASSESSOR'S PARCEL NOS. 0292-44-09, 10, 11 and 12). THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves as follows: Section 1. The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that approximately 2,472 feet of Palmetto Avenue, as more specifically described in Exhibit "A" attached hereto and made a part hereof(the "Street"), is unnecessary for present or prospective public use and that the public interest and convenience require the vacation of that portion of the Street. Section 2. The City Council hereby orders the vacation of a portion of the Street described in the attached Exhibit "A" and depicted on the attached Exhibit`B." Section 3. In connection with the vacation of a portion of the Street described in the attached Exhibit "A," the City of Redlands reserves and excepts from such vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew water lines, sanitary sewers and storm drains and appurtenant structures, in, upon, over, and across said Street or part thereof proposed to be vacated and, pursuant to any existing franchises or renewals thereof, or otherwise, to construct, use, maintain, operate, repair, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment, and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy and for the transmission of intelligence by electric means, petroleum and its products, ammonia, and water, and for incidental purposes, including access, and to otherwise protect these works from all hazards in,upon and over the portion of the Street proposed to be vacated. 1 Section 4. This Resolution shall take effect on the date of the City's approval of City of Redlands Commission Review and Approval No 873 for the proposed development of an approximate 809,338 square foot warehouse distribution center on Assessor's Parcel Nos. 0292- 44-09, 10, 11 and 12.
