HomeMy WebLinkAbout8743RESOLUTION NO. 8743 DECEMBER 2, 2025 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPOINTING RAY CASEY AS AN INTERIM MUNICIPAL UTILITIES AND ENGINEERING DIRECTOR GOVERNMENT CODE SECTION 21221(h) WHEREAS, Government (Gov.) Code section 21221(h) of the Public Employees' Retirement Law permits the governing body to appoint a Ca1PERS retiree to a vacant position requiring specialized skills during recruitment for a permanent appointment, and provides that such appointment will not subject the retired person to reinstatement from retirement or loss of benefits so long as it is a single appointment that does not exceed 960 hours in a fiscal year; and WHEREAS, the City Council of the City of Redlands desires to appoint Ray Casey as an interim appointment retired annuitant to the vacant position of Municipal Utilities and Engineering Director for the City of Redlands under Gov. Code section 21221(h), effective December 9, 2025; and WHEREAS, the City Council of the City of Redlands, the City of Redlands and Ray Casey certify that Ray Casey has not and will not receive a Golden Handshake or any other retirement -related incentive; and WHEREAS, an appointment under Gov. Code section 21221(h) requires the retiree be appointed into the interim appointment during recruitment for a permanent appointment; and WHEREAS, the governing body authorized the search for a permanent appointment on December 2, 2025; and WHEREAS, this Gov. Code section 21221(h) appointment shall only be made once and therefore will end on April 15, 2026, or upon the hiring of the permanent Municipal Utilities and Engineering Director, whichever occurs sooner; and WHEREAS, the entire employment agreement, contract or appointment document between Ray Casey and the City of Redlands has been reviewed by this body and is attached herein; and WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly rate; and WHEREAS, the maximum base salary for this position is $248,964 and the hourly equivalent is $119.69; the minimum base salary for this position is $204,816 and the hourly equivalent is $98.47; and WHEREAS, the hourly rate paid to Ray Casey will be $119.69; and I:\Resolutions\Res 8700.8799\8743 R.Casey.Interim.Appointment.doex jm WHEREAS, Ray Casey has not and will not receive any other benefit, incentive, compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate; and THEREFORE, BE IT RESOLVED THAT the City Council hereby certifies the nature of the employment of Ray Casey as described herein and detailed in the attached employment agreement / contract / appointment document and that this appointment is necessary to fill the critically needed position of Municipal Utilities and Engineering Director for the City of Redlands by December 9, 2025, because the position will be vacant as of this date and executive staffing is needed to continue effective operations and service to the public. Duggan, Jr. City Manager As authorized by Government Code Sections 7522.56 and 21221(h) for "Vacant Positions," I am pleased to offer you an at -will, temporary appointment to the position of Interim Municipal Utilities and Engineering Director with the City of Redlands. The appointment may last up to 960 hours per fiscal year. However, the City reserves the right to end the appointment at any time. If you accept this appointment, your pay rate would be $119.69 per hour and you will perform work of limited duration during the City's recruitment of a Municipal Utilities and Engineering Director, The City confirms that an active recruitment is in place for a permanent replacement. Your start date will be December 9, 2025, and your anticipated end date is April 15, 2026, or upon the hiring of the permanent replacement, whichever occurs sooner. By accepting this offer of at -will, temporary employment, you confirm that you were of normal retirement age when you retired on January 29, 2023, and that there has been greater than a 180-day separation from your date of retirement. Furthermore, you certify that you did not receive any unemployment insurance payments within 12 months prior to this appointment for previous retired annuitant work with any CalPERS employer. In addition, you agree that the City of Redlands will enroll you as a retired annuitant and will report your hours worked with the hourly pay rate to Ca1PERS. As a Ca1PERS retiree, you will be limited to working a maximum of 960 hours per fiscal year for all CalPERS contracting agencies. Subject to, in accordance with, and to the extent provided by the California Government Claims Act [Government Code Section 810 et seq.], the City will indemnify, defend, and hold Ray Casey harmless from and against any action demand, suit, monetary judgment or other legal or administrative proceeding, and any liability, injury, loss, or other damages, arising within the course and scope of his employment. Starting Salary: $119.69 per hour. This rate is within the Municipal Utilities and Engineering Director salary range. No other benefit, incentive, compensation in lieu of benefits, or other forms of compensation will be paid. In entering into this agreement, you acknowledge that you have not relied upon such representations (none of which being in existence) in assessing the CalPERS-related impact of your employment. Therefore, by signing below you release the City, its employees, elected officials, agents, or attorneys from any and all CalPERS-related claims or liabilities that may arise in connection with employment pursuant to this Agreement. This offer of employment contains the entire offer. There are no other expressed or implied promises, representations or contracts being offered to you. Your temporary employment is considered "at will" and termination may occur at any time with or without cause.
