RESOLUTION NO. 4178 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT PORTIONS OF CERTAIN STREETS ARE UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID PORTIONS THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and resolves as follows: SECTION ONE: The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9 , Part 3, Chapter 2, of the Streets and Highways Code of the State of California, and having held a public hearing as provided herein, hereby finds from all evidence submitted that portions of certain streets described in this resolution are unnecessary for present or prospective street purposes and that the public interest and convenience require the closing of said portions of certain streets. The City Council hereby further finds that such vacations are consistent with the City' s General Plan. SECTION TWO : The City Council hereby orders the vacation of a portion of Mill Street as shown on Exhibit "A" and a portion of Citrus Avenue (formerly Sacramento Street) as described in Attachment "B. " SECTION THREE: In the proceeding herein adopted by the City Council for the vacation of a portion of Mill Street as shown on Exhibit "A" and a portion of Citrus Avenue (formerly Sacramento Street) as described in Attachment "B, " the City of Redlands reserves and excepts from the vacations the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any exiting franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the distribution or transportation of electric energy, ammonia, water and incidental purposes, including access and right to keep property free from inflammable materials and wood growth, and to otherwise protect the same from all hazards in, upon, and over the portions of the streets proposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of portions of Dill Street and Citrus Avenue (formerly known as Sacramento Street) described herein are required by public interest, convenience, safety and welfare. {� y ADOPTED, SIGNED AND PRROVED this 16th day of September, 1986. Together with that portion of Citrus Avenue ( formerly Sacramento Street) as shown on Map of Peller, Pratt, and Kendall's Subdivision recorded in Book 5, Page 22, records of said County, lying adjacent to Lot 15, Bleck "B" , of said subdivision and North of the centerline of said Citrus Avenue. Also together with that portion of said Lot 16 as described in the deed to the City of Redlands recorded February 10 , 1941 , in Book 1455, Page 150 , official Records of said County, described as follows: Beginning at the southeast corner of said Lot 16; thence northerly 56.40 feet to a point on the west line of said lot, said point being 40 feet north of the southwest corner of said lot ; thence south 40 feet to the southwest corner of said lot; thence east 53 feet to the point of beginning. Also together with that portion of Lot 1, Block 27, Second Preliminary Hap of Redlands, as per plat recorded in Book 5 of flaps, Page 2, records of said County, lying west of the west line of bill Street as shown on said Map of Lord' s Subdivision and North of the westerly prolongation of the centerline of Citrus Avenue (formerly Sacramento Street) as shown on said Map. Resolution No. 4178 Page three -- All EXHIBIT "B" PARCEL That portion of Citrus Avenue (formerly Sacramento Street) and Mill Street as shown on Map of Lord ' s Subdivision recorded in Book 14 of Maps , Page 10 , records of San Bernardino County, and that portion of Lot 1, Block 27 , Second Preliminary Map of Redlands, as per plat recorded in Book 5 of Maps, Page 2, records of said County, described as follows: Beginning at the northeast corner of Lot 1 of said Lord' s Subdivision; thence alone the north line of said Lot 1 south 890 12 ' 18 " west , 50 . 00 feet to the northwest corner of said Lot l; thence south 00 19' 26" east, 57.89 feet along the west line of said Lot 1 to the southwest corner thereof, said southwest corner being on the northeasterly line of the Moore and Woodworth Brookside Subdivision as recorded in Book 23 of Maps, Page 19 , records of San Bernardino County; thence north 330 59' 00" west, 99.04 feet along said northeasterly line to the westerly prolongation of the centerline of Citrus Aven- as shown on said Lord' s Subdivision; thence north 8�- 12' 18" east, 82,44 feet along said prolongation and said centerline to a non-tangent curve, concave to the northeast, having a radius of 40,00 feet and an initial radial bearing of south 67° 10' 49" west; thence southeasterly along said curve through a central angle of 67° 58' 31" an arc distance of 47,46 feet to a point of tangency with the south right-of-way line of said Citrus Avenue; thence south 890, 12' 18" west along last said line, 14.83 feet to the point of beginning.
