A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
AMENDING RESOLUTION NO. 6380 FINDING THAT A PORTION OF NEW
YORK STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET
PURPOSES AND ORDERING THE VACATION OF SAID PORTION
STREET VACATION NO. 127(AMENDMENT 1)
THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves as
follows:
SECTION ONE: The City Council of the City of Redlands, having elected to
proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets and
Highways Code of the State of California, and having held a public hearing as provided-
therein,
rovidedtherein, hereby finds from all evidence submitted to it that a portion of New York Street
as described in Exhibit "A" (attached hereto and made a part hereof) (the "Street") is
unnecessary for present or prospective public use and that the public interest and
convenience require the closing of a portion of said Street.
SECTION TWO: The City Council hereby orders the vacation of that portion of
New York Street described in Exhibit"A."
SECTION THREE: For the vacation of that portion of New York Street
described in Exhibit"A,"the City of Redlands reserves and excepts from the vacation the
permanent easement and right at any time, or from time to time, to construct, maintain,
operate, replace, remove and renew water lines, sanitary sewers and storm drains and
appurtenant structures, in, upon, over, and across said street or part thereof proposed to be
vacated and, pursuant to any existing franchises or renewals thereof, or otherwise, to
construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits,
cables, wires, poles, and other convenient structures, equipment, and fixtures for the
operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or
distribution of electric energy and petroleum and its products, and for incidental
purposes, including access, and to otherwise protect these works from all hazards in,
upon and over that portion of New York Street proposed to be vacated.

public utility facilities in use in the portion of New York Street to be vacated and hereby
reserves and excepts from the vacation to be effected by this Resolution an easement for,
and the right to maintain, operate, replace, remove and renew, such existing public utility
facilities. Such easement shall be for the length and width of the portion of the street to
be vacated.
SECTION FIVE: This Resolution shall not be recorded and the vacation of the
street shall not become effective unless and until the conditions of approval imposed by
City Departments for the vacation and described in the attached Exhibit "B" are complied
with to the satisfaction of the City's Community Development Department.
ADOPTED, SIGNED AND APPROVED this 1 st day of May, 2007.

Beginning at the point of intersection of the North line of State Street (Citrus Avenue),
having a half-street width of 40 feet, and the centerline of New York Street, thence North
89°51'15" East along said North line 40.00 feet to the East line of New York Street;
Thence N00°43'15"E along said East line of New York Street a distance of 131.52 feet to the
South line of Parcel 2 of Parcel Map No. 5350 as recorded in Parcel Map Book 50, page 45 ,

In lieu of the required sidewalk easement conditioned under Street Vacation No. 127
(Planning Division Condition of Approval No. 6), the Applicant shall dedicate an
easement to the City for public sidewalk and ingress, egress purposes, connecting New
York Street to State Street, following the alignment shown in Exhibit "1," attached
hereto. The form of such easement shall be subject to review and approval by the City.
