SECTION TWO: The City Council hereby orders the vacation of that portion of New York Street described in Exhibit"A." SECTION THREE: For the vacation of that portion of New York Street described in Exhibit"A,"the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew water lines, sanitary sewers and storm drains and appurtenant structures, in, upon, over, and across said street or part thereof proposed to be vacated and, pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment, and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy and petroleum and its products, and for incidental purposes, including access, and to otherwise protect these works from all hazards in, upon and over that portion of New York Street proposed to be vacated. quecoroi g l� gue tea y R First American Title NIBS Recording requested by and when recorded return to: City Clerk's Office City of Redlands P. SECTION FOUR: The City Council hereby acknowledges that there are in-place public utility facilities in use in the portion of New York Street to be vacated and hereby reserves and excepts from the vacation to be effected by this Resolution an easement for, and the right to maintain, operate, replace, remove and renew, such existing public utility facilities. Such easement shall be for the length and width of the portion of the street to be vacated. SECTION FIVE: This Resolution shall not be recorded and the vacation of the street shall not become effective unless and until the conditions of approval imposed by City Departments for the vacation and described in the attached Exhibit "B" are complied with to the satisfaction of the City's Community Development Department. ADOPTED, SIGNED AND APPROVED this 1 st day of May, 2007.
