Box 3005 Redlands, CA 92373 RESOLUTION NO. 5012 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT A PORTION OF A CERTAIN STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID PORTION STREET VACATION NO. 106 THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves as follows: SECTION ONE: The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets and Highways Code of the State of California, and having held a public hearing as provided herein, hereby finds from all evidence submitted that a portion of said street described in Exhibit "A" (attached hereto and made a part thereof) is unnecessary for present or prospective street purposes and the public interest and convenience require the closing of a portion of said street. The City Council hereby further finds that such vacation is consistent with the City's General Plan. SECTION TWO: The City Council hereby orders the vacation of a portion of said street described in the attached Exhibit "A." SECTION THREE: In the proceeding herein adopted by this City Council for the vacation of a portion of said street described in the attached Exhibit "A," the City of Redlands reserves and excepts from the vacations the permanent easement and right at any time, or from time to time to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any exiting franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the distribution or transportation of electric energy water and incidental purposes, including access and right to keep property free from inflammable materials and wood growth, and to otherwise protect the same from all hazards in, upon, and over the portions of the street proposed to be vacated. SECITON FOUR: The City Council hereby determines that the vacation of a portion of said street as described in the attached Exhibit "A" herein is required by public interest, convenience, safety or welfare, if such street portion is not required for present or prospective public purposes. ADOPTED, SIGNED AND APPROVED this 5th day of October, 1993.
