Box 280 Redlands, CA 923 .. �� 7 F ffi i c iF"?' co RESOLUTION NO. 4135 A RESOLUTION OF THE CITY COUNCIL OF TUE CITY OF REDLANDS FINDING THAT PORTIONS OF A CERTAIN STREET ARE UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID PORTION TUE CITY COU14CIL OF THE CITY OF REDLANDS hereby ordains and resolves as follows: SECTION:: E. The City Council of the City of Redlands, haying elected to proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets and Highways Code of the State of California, and having held a public hearing as provided herein, hereby finds from all evidence submitted that portions of a certain street described in this resolution are unnecessary for present or prospective street purposes and that the public interest and convenience require the closing of said portions of a certain street. The City Council hereby further finds that such vacation is consistent with the City's General Plan. SECTION TWO: The Ci—y Council hereby orders the vacation of portions of Fifth Avenue, Northerly of Line A and Southwesterly of Lies L , as described in Attachment ECIC " REE: In the proceeding herein adapted by the City Council for the vacation of portions of Fifth Avenue described in Attachment A, the City of Redlands reserves and excepts from the vacation the perrianent easement and right at any time, or from time e to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any exiting franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and .for the distribution or transportation of electric energy, ammonia, water and incidental purposes, including access and right to peep property free from inflammable materials and wood growth, and to otherwise protect the same from all hazards in, upon, and over the portion of the street proposed to to vacated.
