HomeMy WebLinkAbout3842_CCv0001.pdf RESOLUTION NO. 3842 A RESOLUTION OF INTENTION TO VACATE A PORTION OF A CERTAIN STREET IN THE CITY OF REDLANDS THE CITY COUNCIL OF THE CITY OF REDLANDS does resolve as fol- lows : SECTION ONE: The City Council of the City of Redlands hereby elects to proceed under the provisions of Division 9, Part 3 , Chap- ter 2 , of the Street and Highways Code of the State of California and to vacate a portion of a street in the manner provided therein. SECTION TWO: The City Council does hereby declare its inten- tion to order the vacation of a portion of Henrietta Street described as follows: That portion of Henrietta Street as shown on Record of Survey 15/26 , recorded March 20, 1958 , in the office of the Recorder, County of San Bernardino, State of Cali- fornia, lying 20 feet on either side of the following described centerline of said Henrietta Street: Beginning at a 1/2-inch iron pin marking the intersection of Henrietta Street and Ridge Street as shown on said Record of Survey, thence along said centerline N 52026 ' 15" E, 145 . 50 feet; thence S 68°12 ' 45" E, 196 . 20 feet; thence S 24120 ' 10' E, 132. 53 feet; thence N 87°35 ' 00" E, 60 . 64 feet; thence N 27055 ' 30" E, 61 . 70 feet to the point of termination of said centerline. Said point of termination being S 27°55 ' 30" W, 20 . 00 feet along the centerline of Henrietta Street from a finch iron pipe marking the intersection of said Henrietta Street with Shepherd Street (vacated) as shown on said Record of Survey. Excepting therefrom, that portion of Henrietta Street lying within the 40 foot wide right-of-way of said Sunset Drive. SECTION THREE: The City Council hereby determines that the vacation of the portion of Henrietta Street described above is required by public interest, convenience, safety and welfare. SECTION FOUR: The map setting the particulars of the proposed street vacation shall be on file in the office of the Department of Public Works and available for inspection by persons interested in or objecting to the proposed vacation. SECTION FIVE: The City Council hereby fixes the time and date and place of Public Hearing on the street closing at 7 ; 00 P.M. on the 7th day of September, 1982 , in the regular meeting place of the City Council, Redlands , California . SECTION SIX: Within fifteen days after its passage , this resolution shall be published in the Redlands Daily Facts , a news- paper of general circulation printed and published in the City of Redlands, California . SPF-NCF-P, xc : Mayor and Counci.lmembers City Manager June 7, 1982 650 West Sunset Drive Redlands, California City Council City of Redlands Dear Councillors: May I call to your attention a serious problem within the limits of the City? It pertains to the unpaved portion of Henrietta Street, immediately to the east of Ridge Street. (My wife and I are the property owners on the south side of this unpaved section, Southern California Edison is the owner on the north side.) This section of Henrietta has in effect become a mini city dump. . It is covered with grass cuttings, pruned limbs, nursery containers, beer bottles, broken glass, cigarette stubs, and the like. As such, it constitutes a severe fire hazard and a menace to public health and safety. The road is sometimes navigable and sometimes not, with the result that cars frequently get stuck in the deep ravine on the south side. I respectfully invite members of the council (and others) to visit this site in order to see how serious the problem is. I also respectfully petition that the road be closed and not simply "not maintained" as is its present official status. It has sometimes been contended that the road must be kept open as a fire lane. To this, two responses can be made: one, that a fire truck would not be able to use the road in its present condition, and two, that in a recent fire at the edge of Henrietta and Ridge, the fire vehicles responding to the call used Sunset Drive--which is much the better route. If one suggests that the Police Department be called to patrol the road and prevents its misuse, the answer is that they have been called. Constant patrol is, of course, impossible. If one suggests that the Street Department be contacted, the answer is that they have been contacted and I was advised to petition the Council for closure of the street-become-dump. Public Works Commission - will meet on July 12 , 1982 , at 3: 30 P.M. in the City Hall Conference Room. APPLICATIONS AND PETITIONS The Tri-County Chapter of the Leukemia Society of America' s request for permission to conduct a door-to-door fund Leukemia raising campaign from September 7-21, 1982 , and to pro- Society claim the month of September as Leukemia Month was unani- mously approved on motion of Councilman Martinez , seconded by Councilman Johnson. Council agreed with staff's recommendation that this request should be reviewed annually. The Redlands Optimist Coub was unanimously exempted from Optimist the City' s business license requirements by Section 2122 Club and granted permission to sell juice at the Redlands Bowl evening concerts on motion of Councilman Johnson, seconded by Councilman Gorman. On motion of Councilman Martinez , .seconded by Councilman DeMirjyn, St. Mary' s Catholic Church was unanimously St. Mary' s granted permission to hold their annual barbecue in Sylvan Barbecue Park on July 18, 1982 , and exempted from the City's busi- ness license requirements by Section 2123 to sell food in the park on that same day. Close Mr. Edwin S. Gaustad' s request to blockade a portion of Portion Henrietta Street was tabled on motion of Councilman Henrietta DeMirjyn, seconded by Councilman Gorman, until Council Street had conferred with the City Attorney in a closed session Tabled under the attorney/client privilege. The Redlands Aquatics Club, RACE, was unanimously granted Redlands permission to sell coupon books to the citizens of the Aquatics community with funds to be used to purchase equipment for Club their program on motuion of Councilman DeMirjyn, seconded by Councilman Johnson. COMMUNICATIONS School Board Member Perry Dyke presented suggested revisions School to Ordinance No. 1740 from the School District as follows : Impaction page One : Under Classroom Capacity revise paragraph (a) to read "Classrooms for educational purposes as determined by the Board of Education."
