HomeMy WebLinkAbout8747RESOLUTION NO. 8747 A RESOLUTION OF THE CITY OF REDLANDS AMENDING RESIDENTIAL SPECIFIC PLANS TO UPDATE THE LISTS OF PERMITTED AND ACCESSORY LAND USES AND UPDATE DEVELOPMENT STANDARDS PERTAINING TO THE RAISING OR KEEPING OF CHICKENS (HENS ONLY) WITHIN SINGLE-FAMILY RESIDENTIAL DISTRICTS. WHEREAS; the City has initiated Ordinance Text Amendment No. 371 and related Specific Plan Amendment(s) in accordance with Chapter 18.204 of the Redlands Municipal Code; and WHEREAS, the City has authority under its police power to impose land use regulations and development standards for the protection of the public health, safety, and general welfare; and WHEREAS, on December 9, 2025, the Planning Commission held a noticed public hearing at which interested persons had an opportunity to testify in support of, or opposition to, Ordinance Text Amendment No. 371 and related Specific Plan Amendment(s); and WHEREAS, on December 9, 2025, the Planning Commission recommended to the City Council that the proposed Specific Plan Amendment(s) be approved; and WHEREAS, the proposed Specific Plan Amendment(s) is exempt from environmental review in accordance with Section 15061(b)(3) of the California Environmental Quality Act Guidelines; and WHEREAS, in accordance with Government Code § 65854 and/or § 65090, on January 13, 2026, the City Clerk gave notice by publication in a newspaper of general circulation of the holding of a public hearing at which the proposed Resolution would be considered by City Council; and WHEREAS, on February 3, 2026, the City Council held a noticed public hearing at which interested persons had an opportunity to testify in support of, or opposition to, the proposed Resolution. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS RESOLVES AS FOLLOWS: Section 1. Environmental Determination. The City Council has reviewed the matter and, based upon the facts and information contained in the staff report, administrative record, and written and oral testimony, hereby finds that this Specific Plan Amendment(s) is not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines because: there is no possibility that the Specific Plan Amendment(s) may have a significant effect on the environment, as it would further ensure the proper maintenance and regulations for the keeping of chickens (hens only) as an ancillary land use to the primary residential land use(s) within the various single-family residential districts of specific plans within 1 19Reso1utions\Res 8700-8799\Resolution No.8747.13M.01.21.2026.DOCX the City; and Section 15378(b)(5) for organizational and administrative activities of governments that will not result in direct or indirect physical changes in the environment. Section 2. The single-family residential districts of adopted Specific Plans within the City of Redlands are hereby amended to include the following accessory land use within each of their respective single-family residential district(s): "Keeping of chickens (hens only), associated with a primary single-family dwelling unit, in accordance with Section 18.29.030 of Chapter 18.29 of Title 18 (Zoning Regulations) of the Redlands Municipal Code." The applicable specific plans are the following: a. Specific Plan No. 43 (Neighborhoods 1, 2, 3, and 4); b. Specific Plan No. 47 (Section 4, sub -part (A)(2)); c. Specific Plan No. 55; d. Specific Plan No. 56 (Section II, sub -part (A)); e. Specific Plan No. 59 (Section 4, sub -part (A)(2)); f. Specific Plan No. 60 (Section II, sub -part (B)); g. Specific Plan No. 61 (Section 3, sub -part (B)); h. Specific Plan No. 62 (Section 2, sub -part 2.2(B)). Section 3. Specific Plan No. 23, subsection `B. Residential," is hereby amended as follows: "B. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this resolution for any reason is held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this resolution. The City Council hereby declares that it would have adopted this resolution, each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. Section 5. Effective Date. This Resolution shall become effective upon adoption.
