HomeMy WebLinkAbout7102_CCv0001.pdf RESOLUTION NO. 7102 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, CALIFORNIA TO DENY STREET VACATION NO. 154 WHEREAS,BNY,INC.has submitted an application to vacate approximately 317 linear feet of Crystal Court located on the east side of Occidental Drive, approximately 657 feet north of Brockton Avenue in the R-1 (Single Family Residential) District("Street Vacation No. 154"); and WHEREAS,the Planning Commission of the City of Redlands has reviewed Street Vacation No. 154 and made a written recommendation to deny that street vacation request to the City Council after holding a noticed public hearing; and WHEREAS,notice of this City Council's public hearing for the Street Vacation No. 154 was duly published in the Redlands Daily Facts by the Redlands City Clerk; and WHEREAS,on December 20th,2011 the City Council held a public hearing and considered the staff written and oral reports, the recommendation of the Planning Commission,the testimony and written evidence submitted by and on behalf of the applicant for Street Vacation No. 154 and by members of the public; and I WHEREAS,the public hearing on the Street Vacation No. 154. was continued to March 20, 2012, then to April 3, 2012, and subsequently to April 17, 2012 for additional testimony by the applicant for Street Vacation No. 154 and the public; and WHEREAS, following the public hearing on Street Vacation No. 154, the City Council determined that denial of the requested street vacation is in the best interests of the public health, safety and general welfare; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. The application for Street Vacation No. 154 is denied because the City Council finds from all of the evidence submitted to it that the street in question remains necessary for present and prospective public use.
