Box 2090 . _ Redlands, CA 92373 i 3 PH RESOLUTION NO. 4300 ` ° ¢ s` I CO., C"ALIi a A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT A PORTION OF A CERTAIN" ALLEY IS UNNECESSARY FOR PRESENT OR PROSPECTIVE ALLEY PURPOSES AND ORDERING THE VACATION OF SAID PORTION (ALLEY VACATION NO. 91) THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and resolves as follows, SECTION ONE: The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3 , Chapter 2, of the Streets and Highways Code of the State of California, and having weld a public hearing as f; provided herein, hereby finds from all evidence submitted that portion of said alley described in Exhibit "A" (attached) is unnecessary for present or prospective streets and alleys purposes and that the public interest and ' convenience require the closing of portion of said alley. The Cite Council hereby further finds that such vacation is consistent with the City' s General Plan. SECTION TwO: The City Council hereby orders the vacation of portion of said alley described in the attached Exhibit "A. " SECTION THREE: In the proceeding herein adopted by this City Council for the vacation of portion of said alley described in the attaches Exhibit "A" the City of Redlands reserves and excepts from the vacations the permanent easement and right at any time, or front. time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street or alley or part thereof proposed to be vacated and pursuant to any exiting franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lanes, telegraphic and telephone lines, and for the distribution or transportation of electric energy, water and incidental purposes, including access and right to keep property free from inflammable materials and wood growth, and to otherwise protect the same front all hazards i Uw 9204 m r S SECTION FOUR: The City Council hereby determines that the vacation of portion of said alley as described in the attached Exhibit "A" herein. is required by public interest, convenience, safety and welfare. ADOPTED, SIGNED AND APPROVED this 20th day of October, 1987 . Councilmember Larsen CtyClerk Resolution No. 4300 Page two - 87-380204 EXHIBIT "A" LEGAL DESCRIPTION In the City of Redlands, County of San Bernardino, State of California that portion of Lots 2, 3, 4 and Lot 13 of Block 19 of the TOWN PLAT OF REDLANDS as recorded in Map Book 5, Page 10 Records of tan Bernardino County lying Northeasterly of the highway as said highway is described in that certain final Judgment in Condemnation recorded August 31, 1938 in Book 1292, Pago 402 Official Records. Together with the south half of the Alloy (vacated) lying Easterly of the Northerly projection of the west line of said Lot 4 and Westerly of the Northerly projection of the east line of said Lot 2 and the north half of the Alley (vacated) lying within the Southerly projection of the East and West line of said Lot 13.
