Box 3005 Dec#: 2008—0533582 Titles: 1 Pages: 6 Redlands, CA 92373 Fees 0.00 Faxes 0.09 Other 0.00 PAID $0.06 ETES NOT REQUIRED PER GOVERNMENT CODE SECTION K03 RESOLUTION NO, 6779 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT AN EXISTING ALLEY EAST OF EUREKA STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID PORTION STREET VACATION NO. 145 THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves as follows: SECTION ONE. The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that an existing alley east of Eureka Street from Pearl Avenue southerly a length of approximately 700 feet as described in Exhibit "A" (attached hereto and made a part hereof) (the "Street") is unnecessary for present or prospective public use and that the public interest and convenience require the closing of said Street. SECTION TWO: The City Council hereby orders the vacation of said Street described in the attached Exhibit "A." SECTION THREE: For the vacation of said Street described in the attached Exhibit "A," the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew water lines, sanitary sewers and storm drains and appurtenant structures, in, upon, over, and across said street or part thereof proposed to be vacated and, pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, DJM\Resot6779 wires, poles, and other convenient structures, equipment, and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, and water, and for incidental purposes, including access, and to otherwise protect these works from all hazards in, upon and over the portion of the street proposed to be vacated. SECTION FOUR: The City Council hereby acknowledges that there are in-place public utility facilities in use in the street to be vacated and hereby reserves and excepts from the vacation to be effected by this Resolution an easement for, and the right to maintain, operate, replace, remove and renew, such existing public utility facilities. Such casement shall be for the length and width of the street to be vacated. ADOPTED, SIGNED AND APPROVED this 18"' day of November, 2008.
