Box 3005 Redlands, CA 92373 RESOLUTION NO. 5258 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT A PORTION OF A CERTAIN ALLEY IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID PORTION STREET VACATION NO. 113 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS as follows: SECTION ONE: The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets and Highways Code of the State of California, and having held a public hearing as provided herein, hereby finds from all evidence submitted that a portion of said alley described in Exhibit "A" (attached hereto and made a part thereof) is unnecessary for present or prospective public use and that the public interest and convenience require the closing of a portion of said alley. SECTION TWO: The City Council hereby orders the vacation of a portion of said alley described in the attached Exhibit "A." SECTION THREE: In the proceeding herein adopted by this City Council for the vacation of a portion of said alley described in the attached Exhibit "A," the City of Redlands reserves and excepts from the vacations the permanent easement and right at any time, or from time to time to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any exiting franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the distribution or transportation of electric energy water and incidental purposes, including access and right to keep property free from inflammable materials and wood growth, and to otherwise protect the same from all hazards in, upon, and over the portions of the alley proposed to be vacated. ADOPTED, SIGNED AND APPROVED this 5th day of March, 1996. Mayor ATTEST: City Clerk 1, Lorrie Poyzer, City Clerk of the City of Redlands hereby certify that the foregoing resolution was adopted by the City Council at a regular meeting thereof on the day of 1996, by the following vote: AYES: NOES: ABSENT: City Clerk Resolution No. 5258 Page two - EXHIBIT 'A' That portion of the north-south alley between Orange Street and Third Street, north of Stuart Avenue described as follows: That portion of Lots 6,7,8,9 and 10 according to Map of the east 112 of the east 1/2 of Lot 28, Block 77, Rancho Bernardino, in the City of Redlands, as per plat recorded in Book 8 of Maps, Page 62, records of San Bernardino County, more particularly described as follows: The west 16 feet of said Lots 6,7,8,9 and 10, as conveyed to the City of Redlands, as per deed recorded in Book 404, Page 231 of deeds, records of San Bernardino County, for purpose of an alley. ,J RONALD C.
