STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID ALLEY STREET VACATION NO. 141 THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves as follows: SECTION ONE: The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted to it that an alley as described and as shown on map attached as Exhibit "A" (attached hereto and made a part hereof) (the "Alley") is unnecessary for present or prospective public use and that the public interest and convenience require the closing of said Alley. SECTION TWO: The City Council hereby orders the vacation of that portion of said Alley described and as shown on map attached as Exhibit "A". SECTION THREE: For the vacation of the Alley described and as shown on map as Exhibit "A", the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew water lines, sanitary sewers and storm drains and appurtenant structures, in, upon, over, and across said street or part thereof proposed to be vacated and, pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment, and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy and petroleum and its products, and for incidental purposes, including access, and to otherwise protect these works from all hazards in, upon and over the Alley proposed to be vacated. DJMlfteso16628 SECTION FOUR: The City Council hereby acknowledges that there are in-place public utility facilities in use in that Alley to be vacated and hereby reserves and excepts from the vacation to be effected by this Resolution an easement for, and the right to maintain, operate, replace, remove and renew, such existing public utility facilities. Such easement shall be for the length and width of the portion of the Alley to be vacated. SECTION FIVE: This Resolution shall not be recorded and the vacation of the street shall not become effective unless and until the conditions of approval imposed by City Departments for the vacation and described in the attached Exhibit "B" are complied with to the satisfaction of the City's Community Development Department.
