A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS IN
SUPPORT OF AB 844 (BERRYHILL); AN ACT TO AMEND SECTION 21609
OF, AND TO ADD SECTIONS 21608.5 AND 21610 TO, THE BUSINESS
AND PROFESSIONS CODE., RELATING TO JUNK DEALERS.
WHEREAS, metal theft has been plaguing every region of California and wreaking
economic havoc across all of society; and
WHEREAS, the City of Redlands, in both public and private places, has been hard flit by
this crime wave, with recent thefts of metal plaques, piping, and electrical wiring throughout the
City; and
WHEREAS, existing law has been insufficient in stemming this tide of theft; and
WHEREAS, Assembly Bill 844 ("AB 844") has been introduced in the California
Legislature to close loopholes in existing laws and strengthen law enforcement; and
WHEREAS, to assist law enforcement in stopping and prosecuting theft, AB 844 will
require junk dealers and recyclers to pay by check with a three-day hold, require govenunent-
issued identification, and require photographs of recycled materials; and
WHEREAS, AB 844 requires a person, junk dealer or recycler to pay damages if the
person is convicted of theft, or the junk dealer or recycler is convicted of the sale of property that
has been placed on hold by a peace officer; and
WHEREAS, AB 844 keeps in place existing penalties, protects local ordinances that are
more restrictive than state law, and exempts transactions under ten dollars.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of
Redlands, that the City of Redlands supports AB 844 and urges its passage in the version
amended in the California Senate on April 30, 2008.
