HomeMy WebLinkAbout2443_CCv0001.pdf RESOLUTION NO . 2443 A RESOLUTION OF THE CITY COUNCIL, CITY OF REDLANDS , IN SUPPORT OF ASSEMBLY BILL NO . 1642 , WITH PROPOSED AMEND- MENTS THERETO, AND IN OPPOSITION TO ASSEMBLY BILL NO . 592 The City Council of the City of Redlands hereby finds , determines and resolves as follows : WHEREAS, this Council has made a study and review of Assembly Bill No. 1642 , being an act to repeal and amend certain sections of the Government Code , relating to local agencies and the Local Agency Formation Commission; and WHEREAS, relative to said Assembly Bill No. 1642, this City Council considered certain proposed amendments thereto and ap- proved and endorsed or disapproved and rejected same as follows , CONSIDERED, APPROVED AND ENDORSEDz 1 . Would eliminate publication requirement , as such will significantly increase total costs of LAFC and does not do the job of notifying the people. 2. Would require notification of compliance with LAFC recommendations be filed with LAFC. 3. Would set up procedure requiring agency to inform public or LAFC when proposal is officially terminated. 4. Would provide that city alternate would act in place of any commissioner who might d1squality himself for any reason or because of absence. 5. Would add preamble outlining general purposes of LAFC. 6. Would provide that only County Supervisors are eligible to represent County government on LAFC. 7. Would make clear that LAFC may study governmental situation within counties and make recommendation for govern- mental change. 8. Would make clear that a county may accept public and/or private grants to finance these studies by LAFC. 9. Would eliminate Boundary Commission, 10. Would eliminate statutory protection periods in the annexation statutues . Place protection period of 90 days in LAFC statute . Would run from date of filing with LAFC. 1 of CONSIDERED BUT NOT APPROVED OR ENDORSED: 1 . Would Include county service areas under the jurisdic- tion of the LAFC. 2. Would allow city and county alternates to serve when regular members are absent or disqualify themselves (No. 4 approved above was preferred) . 3. Would allow Board of Supervisors to authorize per them for LAFC members . 4. Would give LAFC jurisdiction over exclusion of territory from cities (insufficient information on proposed amendment) . 5. Would allow LAFC to waive prohibition against annexa- tions which would form islands if Commission found that such prohibitions would be detrimental. to the orderly development of the community. 6. Would give LAFC discretionary power to consent to inclusion of territory in a proposal, which territory was included in a proposal which had been previously disapproved by the LAFC. 7- Would increase the number of Commission members to seven and provide that representatives of districts fill the two additional seats . 8. Would set standard procedures for considering both an incorporation proposal and an annexation proposal (recom- mends the present procedure be retained whereby hearings on incorporations are held before the LAFC after the circulation of required petitions ) ► and WHEREAS, this Council has made a study and review of Assembly Bill No. 592 , being an act known and referred to as the "District Reorganization Act of 1965" , purportedly providing for a uniform procedure for the initiation, conduct and completion of proceedings for annexations , detachments , dissolutions and con- solidations of districts ; and WHEREAS , relative to said Assembly Bill No. 592, this Council ' s judgment is that said act , as proposed, is too cumber- some, complicated, detailed and expensive for practical implemen- tation, and action should be deferred. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands, that Assembly Bill No. 1642 , as introduced by Assemblyman Knox to the California Legislature, 1965 Regular Session, be approved and endorsed with the recommendation that the hereinbefore proposed amendments "considered, approved and endorsed" by this Council be -incorperated Into and made a part of said act. 2 BE IT FURTHER RESOLVED: That action on Assembly Bill No . 592 , known as the "District Reorganization Act of 1965" , introduced by Assemblymen Knox, Song, Brown, Alquist and Warren to the California Legislature , 1965 Regular Session, be deferred, and that said bill be referred back to the Committee on Municipal and County Governments for further study. BE IT FURTHER RESOLVED: The City Clerk is hereby directed to certify to the passage of this resolution and to forward copies of the same to Senator Eugene G. Nisbet and to Assemblymen Stewart Hinckley and John P. Quimby, and that additional copies of this resolution be sent to Roger. N. Kehew Jr. , Legislative Advocate for the County of San Bernarding, for distribution to Assemblymen Knox, Song, Brown, Alquist and Warren. BE IT FURTHER RESOLVED: That copies of this resolution be sent to the Board of Supervisors of the County of San Bernardino and to the respective City Councils of all cities located within the County of San Bernardino, Adopted, Signed and approved this e) day of zlt-,�,,z 1965.
