Pursuant to authority delegated to me by action of the City Council of the City of
Redlands (hereinafter referred to as Agency) dated August 12, 1993, under Section
21034, Government code, and after review of medical and other evidence relevant
thereto, I hereby determine that Tony Perkins, a local safety member of the Public
Employees' Retirement System, employed by the Agency is incapacitated within the
meaning of the Public Employees' Retirement Law for performance of his duties in the
position of Police Officer.
(1) Pursuant to such authority I also determine that such incapacity is a result of
injury or disease arising out of and in the course of his employment as a local safety
member. I further determine that such disability did not result from an injury which
is the direct consequence of a violent act perpetrated upon the member. The injury
did not occur during the performance of those portions of the member's duties which
are particularly hazardous and dangerous. I certify that neither the Agency nor the
member has filed a petition for determination under Government Code Section 21026,
to be made by the Workers' Compensation Appeals Board.
(2) 1 hereby certify that the member will be separated from his employment in the
position Police Officer after expiration of his leave rights under Section 21025.4,
Government Code, effective July 27, 1993 and that no dispute as to the expiration
of such leave rights is pending.
(3) There is not a possibility of third party liability.
(4) Advanced Disability Pension payments will be made in the amount of $1492.65
per month beginning July 28, 1993.
(5) The primary disabling condition is an injury to the shoulder.
