A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS TO
DENY TENTATIVE TRACT MAP 18795
WHEREAS,BNY,INC.has submitted an application for a Tentative Tract Map to subdivide
approximately 3.14 acres into thirty six (36) numbered lots and one common lot for a townhome
development located on the east side of Occidental Drive,approximately 657 feet north of Brockton
Avenue("Tentative Tract Map No. 18795"); and
WHEREAS,the Planning Commission of the City of Redlands has reviewed Tentative Tract
No. 18795 and made a written recommendation for denial of that tentative tract to the City Council
after holding a noticed public hearing; and
WHEREAS,notice of this City Council's public hearing for Tentative Tract No. 18795 was
duly published in the Redlands Daily Facts by the Redlands City Clerk; and
WHEREAS,on December 20th,2011 the City Council held a public hearing and considered
the staff written and oral reports,the recommendation of the Planning Commission,the testimony
and written evidence submitted by and on behalf of the applicant and by members of the public;and
WHEREAS,the public hearing for Tentative Tract No. 18795 was continued to March 20,
2012, then to April 3, 2012, and subsequently to April 17, 2012 for additional testimony by the
applicant for Tentative Tract No. 18795 and the public; and
WHEREAS,following the public hearing on the Tentative Tract No. 18795 the City Council
determined that denial of the proposed tentative tract is in the best interests of the public health,
safety and general welfare;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as
follows:
Section 1. Tentative Tract Map No. 18795 is hereby denied based upon the following
findings:
A. The proposed map is not consistent with the General Plan land use designation of
Low Density Residential.
B. The subdivision project permitted by the proposed map does not meet the
development standards of the R-I zoning designation because:
(i) The allowable density under the R-I District is exceeded by proposed Tentative
Tract No. 18795.
(ii) The lot sizes proposed by Tentative Tract No. 18795 are inconsistent with the
R-I District.
