A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDLANDS AUTHORIZING TRAFFIC ENFORCEMENT ON
PROSPECT DRIVE, A PRIVATELY OWNED AND MAINTAINED
STREET WITHIN THE CITY
WHEREAS, California Vehicle Code section 21107.6 authorizes a City to adopt an
ordinance or resolution, following a public hearing, finding and declaring that certain
privately owned and maintained streets are generally held open to the public for purposes of
vehicular travel to serve commercial establishments and,upon adoption of such an ordinance
or resolution,that the provisions of the California Vehicle Code shall become applicable to
and enforceable on those private streets; and
WHEREAS,the City Council of the City of Redlands hereby intends to utilize such
authorization and thereby authorize(but not mandate)police officers of the City of Redlands
to enforce any and all California Vehicle Code regulations, including but not limited to
traffic and parking regulations, within certain private streets; and
WHEREAS,Prospect Drive, a portion of which is privately owned and maintained,
and which is held open to the public by the Kimberly Shirk Association for the purpose of
vehicular travel to serve the Kimberly Crest House and Gardens located in Prospect Park;
and
WHEREAS, ten (10) days prior written notice of the City Council's proposed
adoption of this resolution has been provided to the owner of Prospect Drive, and
subsequently, on November 19, 2013, a duly noticed public hearing was held by the City
Council at which interested persons were provided the opportunity to provide verbal and
written testimony regarding this resolution;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Redlands as follows:
Section 1. The City Council hereby finds and declares that Prospect Drive, a
privately owned and maintained street which is depicted on the map attached hereto as
Exhibit"A,"has been held open to the public for the purpose of vehicular travel to serve the
Kimberly Crest House and Gardens in Prospect Park. Pursuant to California Vehicle Code
section 21107.6,the City Council hereby authorizes(but does not mandate)police officers
of the City of Redlands to enforce any and all California Vehicle Code regulations,including
but not limited to traffic and parking regulations, within Prospect Drive.
