WHEREAS, the Council has elected to proceed under the provisions of the Public Streets, Highways, and Service Easements Vacation Law, Division 9, Part 3 of the California Streets and Highways Code ("S&H Code"), and specifically Chapter 4 commencing with Section 8333(c) provides that the City may vacate an easement if the easement has been superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement, thereof, to vacate the public service easement known as `water line easement' located at 1780 Country Club Drive, Redlands, California (APN 0176-211-11-0000); and WHEREAS, Sections 8335 and 8336 of the S&H Code provide that the City Council may summarily vacate a public service easement by adopting a resolution of vacation and following the procedures outlined in the S&H Code; and WHEREAS, the owner of the property is requesting the vacation of the public service easement known as `water line easement' located at 1780 Country Club Drive, Redlands, California, as described on Exhibit A and as shown on Exhibit B of Attachment A, the Summary Vacation Deed, which are attached and incorporated in this Resolution the public service easement has been superseded by relocation and not other public facilities are located within the easement; and WHEREAS, the purpose of this proposed vacation is to accommodate the development of the property with single-family residence, and the subject easement constitutes a title encumbrance affecting such development; and WHEREAS, the Municipal Utilities and Engineering Department and Development Services Department have reviewed this proposal and have approved the vacation with no conditions after determining that there are no public utility facilities and no additional public improvements within the property proposed for vacation as described on Exhibit A and as shown on Exhibit B of Attachment A, the Summary Vacation Deed; and WHEREAS, this action is being taken pursuant to the provisions of the Public Streets, Highways, and Service Easements Vacation Law (S&H Code §§ 8300-8363). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. The findings set forth above are true and correct and are incorporated by reference herein. Section 2. The City Clerk shall certify the passage of this Resolution and shall file a certified copy, attested by the City Clerk under the seal of the City of Redlands, to be recorded in the Office of the County Recorder of the County of San Bernardino, State of California. Section 4. This vacation shall become effective on the date this resolution is recorded ADOPTED, SIGNED AND APPROVED this 21 st day of July, 2026.
