HomeMy WebLinkAbout5440_CCv0001.pdf RESOLUTION NO. 5440 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ADOPTING THE URBAN WATER MANAGEMENT PLAN WHEREAS, Sections 10610 et seq. of Division 6 of the California Water Code require urban water suppliers with more than 3000 service connections to prepare and file with the Department of Water Resources an Urban Water Management Plan; and WHEREAS, the City of Redlands recognizes that the water supply of the City represents a limited renewable resource subject to increasing demands;that the conservation and efficient use of urban water supplies are of statewide concern; and that the planning for water use and conservation and the implementation of such plans is best accomplished at the local level; and WHEREAS, it is in the best interests of Redlands' citizens to ensure that the highest quality of water is reasonably available to them for domestic use; and WHEREAS, the City has developed its Urban Water Management Plan to achieve water conservation, efficient use of water and sustainable lifestyle consistent with Redlands' unique heritage and community goals; and WHEREAS, a duly noticed public hearing has been held on the Urban Water Management Plan pursuant to Section 6066 of the California Government Code; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. That the document entitled "Urban Water Management Plan" is hereby adopted and the Chief of Water Resources is hereby directed to file a copy of the plan with the California Department of Water Resources within 30 days of the date of this resolution. Section 2. That the City of Redlands will implement the 1995 Urban Water Management Plan in accordance with the schedule set forth in the plan. MEMORAN12UM TO: GARY PHELPS FROM: CITY ATTORNEY DATE: NOVEMBER 20, 1997 RE: PROPOSED ADOPTION OF I995 URBAN WATER MANAGEMENT PLAN Gary, this is just a reminder regarding the legal requirements which the City must meet before adopting its Urban Water Management Plan for the year 1995. Section 10642 of the California Water Code provides that prior to adopting an Urban Water Management Plan,the water supplier shall make the plan available for public inspection and shall hold a public hearing thereon. Prior to the hearing, notice of the time and place of the hearing must be published within the City pursuant to Section 6066 of the California Government Code. That Government Code section reads: "Publication of notice pursuant to this section shall be once a week for two successive weeks. Two publications in a newspaper published once a week or oftener,with at least five days intervening between the respective publication dates not counting such publication dates, are sufficient. The period of notice commences upon the first day of publication and terminates at the end of the fourteenth day, including therein the first day." You should also be aware that the Water Code was amended in 1995 to include the requirement that "each urban water supplier shall encourage the active involvement of diverse, social, cultural, and economic elements of the population within the service area prior to and during the preparation of the plan." To the extent we adopt the plan by resolution, we should add language in the text of that document noting that we have complied with this "active involvement" requirement. Also, we may wish to also mention that we have complied with Water Code section 10641 which states that the urban water supplier may consult with and obtain comments from, any public agency or state agency or any person who has special expertise with respect to water demand management methods and techniques in connection with the preparation of our Urban Water Management Plan.
