RESOLUTION NO. 2678
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF REDLANDS URGING THE ENACTMENT OF S .B . 425
WHEREAS S .B . 425 is currently being considered by the State
Senate; and
WHEREAS such legislation will clarify the preemption of
local ordinances by State laws ; and
WHEREAS we are concerned that long-standing city ordinances
are continually questioned as invalid, as a result of preemption
by the State; and
WHEREAS we are concerned that uncertainty as to preemption
hinders investigations and prosecutions for the violation of
certain matters regulated by local ordinance in the past; and
WHEREAS we are concerned that the Redlands City Council is
handicapped in enacting speedy legislative solutions to regional
problems --- riot control, new weapons control, topless and other
matters requiring local control ;
BE IT THEREFORE RESOLVED that the City Council of the City
of Redlands does hereby urge the enactment of S .B. 425, which
removes the question concerning the validity of local ordinances
by requiring the State Legislature to affirmatively specify when
local authorities may not enact ordinances in a particular field.
