A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF REDLANDS ESTABLISHING REGULATIONS FOR THE
EXTENSION OF CITY WATER AND SEWER SERVICES
OUTSIDE THE CITY' S BOUNDARIES
WHEREAS, Redlands and the State of California as a
whole are suffering from a fourth consecutive year of drought with
1990 shaping up to be the most severe of the four, according to
the State Department of Water Resources ; and
WHEREAS, as a result of the drought conditions , cities
throughout the State are adopting mandatory and voluntary water
conservation programs and establishing regulations governing the
use of water for the protection of water resources ; and
WHEREAS , in 1987 , voters of the City of Redlands approved
an initiative ordinance commonly known as Measure "N" to moderate
the rate of growth in and around Redlands in part, based upon
their finding that Redlands ' quality of life continues to
deteriorate because of higher utility rates to subsidize growth,
increased water pollution and the overburdening of water and sewer
facilities ; and
WHEREAS, the City Council of the City of Redlands ( "this
City Council" ) recognizes that limited sources of water exist to
meet the needs of the current residents of Redlands and to serve
the future needs of new development proposed in and around the
City of Redlands ; and
WHEREAS, this. City Council has determined that the
anticipated demand for water and sewer service from uncontrolled
growth of new development outside the boundaries of the City would
place undue strain on the City' s utility system and its present
water resources ; and
WHEREAS, this City Council has determined that for the
protection of the public ' s health , safety and welfare , and to
carry out the purpose and intent of Measure "N, " it is in the best
interests of the residents of Redlands that the City establish
regulations for the extension of water and sewer services to new
development outside the City' s boundaries ;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Redlands as follows :
Section 1 . Extension of Water and Sewer Services
Outside the City' s Sphere of Influence . Water and sewer service
shall not be extended to properties outside the City' s sphere of
influence except upon the approval by the City of an application
for water and sewer service which demonstrates to the satisfaction
of the City that the development project seeking water and sewer
service complies with the City' s general plan, the City' s
ordinances regulating density for proposed land uses and with the
City' s voter--approved initiatives commonly known as Proposition
"R" and Meaure "N. " The application shall also contain written
consents to the provision of water and sewer service by Redlands

from the legislative body of the jurisdiction in which water and
sewer service is proposed to be extended and any public agency or
private water company which the City determines might have the
ability to provide water and sewer service to the proposed
development project.
Section 2 . Extension of Water and Sewer Services to
Properties Within the City' s Sphere of Influence and
Non-Contiguous to the City' s Boundaries . Water and sewer service
shall not be extended to properties within the City' s sphere of
influence that are non-contiguous to the City' s boundaries except
upon the approval by the City of an application for water and
sewer service which demonstrates to the satisfaction of the City
that the development project seeking water and sewer service
complies with the City' s general plan, the City ' s ordinances
regulating density for proposed land uses and with the City' s
voter-approved initiatives commonly known as Proposition "R" and
Measure "N. " The application shall also contain written consents
to the provision of water and sewer service by Redlands from any
public agency or private water company which the City determines
might have the ability to provide water and sewer service to the
proposed development project .
Section 3 . Extension of Water and Sewer Service to
Properties Within the City ' s Sphere of Influence and Contiguous
to the City' s Boundaries . Water and sewer service shall not be
extended to properties within the City ' s sphere of influence that
are contiguous to City boundaries . Any such property seeking

water service shall , as a condition precedent of obtaining water
and sewer service , initiate and successfully complete proceedings
for annexation of the property to the City of Redlands .
Section 4 . Applicability. The regulations established
by this Resolution shall apply to all new residential and non-
residential development that seeks water or sewer services from
the City.
