A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ES'T'ABLISHING
RATES AND CHARGES OF THE WATER DIVISION IN ACCORDANCE WITH ORDINANCE
NO. 1441 AND RESCINDING RESOLUTIONS NOS . 2927 and 3154
BE IT RESOLVED by the City Council of the City of Redlands that
the water rates and charges for water consumed on or after April 1,
1976 shall be as follouls :
SECTION ONE: Domestic, Commercial and Irrigation Water Rates.

SEC'_PTON -TWO: Bills shall be computed bi-monthly. For the purpose
of deterr-nining monthly consumption as set forth in Section One (b) ,
monthly consumption shall be considered as being one-half of bi-monthly
consumption.
SECTION THREE : Miscellaneous tater usage.
(a) Miscellaneous usage of water and charges for miscellaneous
usage of water shall be determined and authorized by the Utility Super-
intendent prior to said usage. The following rate shall apply to
miscellaneous usage of water:
(1 ) For backfilling of ditches, a rate of three cents
per lineal foot of ditch for all ditches less than
three (3) feet in depth.
(2) For backfilling of ditches greater than three (3 )
feet in depth at a rate to be determined by the
Utility Superintendent.
(3 ) For orchard spraying, a rate of $2 . 50 per rig per day
or portion thereof.
( ) The Vater Division may provide a meter for any of the
above uses and require a suitable deposit guaranteeing
return of meter in working condition. Water used
through such meter shall be at the rate of twenty-
two cents (22�) per hundred dubic feet, with a mini-
um charge of ten dollars ($10.00) per month or por-
tion thereof. All such meters shall be returned for
reading and checking within ninety (90) days after
issuance.
(b) Except for fire protection or emergency purposes, fire
hydrants shall not be used to obtain unmetered water unless a permit
to do so has first been obtained from the Water Division or Fire
Department and then only for public improvement construction purposes
or orchard spraying inside the city limits .
For a fire hydrant permit, a charge of one dollar ($1,00)
shall be made in addition to charges for water used. Permits shall
expire in thirty= 30) days unless a shorter period is specified there-
on.
SECTION FOUR: N. ew Service Installation Charges . The Water
Division shall make the following charges for the installation and
maintenance of services and for meters ; such charge or estimated
charge to be Dad in advance :
(a) To ex 8t ,ng mains : Includes connection to main, lateral,
curb stop, meter and box.

(b) Within subdivision or lot splits where new mains are Laid
to City specifications and service lateral is installed to lot at the

(e) All services larger than two inches (2 ") or any one and one-
half inch (1-1/2 ") or two inch (2" ) which will exceed the charge. set

and service lateral, and all labor for installation plus ten per
cent (10!) .
SECTION FIJI : Fire and. Protective Service Connection.
(a) The monthly rates to be charged for stand-by service used
for fire protection purposes shall be as follows :

(b) Stand-by fire service connections shall be installed b y the
Grater Division in accordance with Section Four of this resolution.
SECTIO: SIX: Service provided to publicly-owned property which
is used exclusively for park and recreation purposes shall be
charged the lowest domestic rate block established by this resolu-
tion.

followed with a few words of prayer by Reverend J.

The minutes of the regular meeting of April 6, 1976,
were approved as submitted.

roads in Hillside Memorial Park were opened and
publicly declared in the office of the City Clerk at

After study by the Public Works Department staff and
the Cemetery Superintendent, it is the recommendation
Award that the bid of Crown. Asphalt Coating be accepted,
Cemetery On motion of Councilman Miller, seconded by Council-
Roads woman Grace, the award was made to Craw n Asphait
Coating of Ontario in the amount of $5, 939.00, as
this was the low bid and fully qualified,

PUBLIC HEARINGS
Resolution No. 3245, a resolution of the City Council
of the City of Redlands adopting Precise Street Plan
No. 17, set the public hearing on this street plan for
this time and place. Mayor DeMirjyn opened the meeting
Resolution as a public hearing for any comments or questions
No. 3245 concerning Precise Street Plan No-, 17, which establishes
Precise a specific alignment for that portion of Wabash Avenue
Street within the city limits of Redlands . No comjr,,ents or
Plan questions being forthcoming, the public hearing was
No. 17 declared closed. On motion of Councilman Miller,
seconded by Councilwoman Grace, Resolution No, 3245'
Precise Street Plan No. 17 was adapted pted by the
following roll call vote :

Public hearing was also, advertised for this time and
place on ordinance No, 1577, an ordinance cif the C.itv
Council of the City of Redlands amending Zoning
ordinance Ordinance 1000 to adept Amendment No. 129 thereto
No. 1577 which affects the uses permitted in the Agricultural
Animals in District . Mayor DeMirjyn again opened the meeting as
Agricultural a public hearing for any questions or comments . None
Zone being forthcoming, the public hearing was declared
closed, and ordinance No, 1.577 was adopted, with
waiver of reading of the ordinance in fulI., on motion
of Councilman Elliott, Seconded by Councilman Knudsen
with the following roll call vote '

ORAL PETITIONS FROM THE FLOOR
Mr . David Turner addressed Council concerning the water
rate change adopted at the last meeting in Resclution
No, 3247. He also presented petitions which he stated
contained 870 signature8, and read a prepared Statement,
Mr . Turner requested the Council to rescind the increa�e
and allow a period of time to form an ad hoc committee
to study the matter, Mr. Eldon Vincent concurred with
Mr . Turner. My . Eric Pohl. addressed Council concerning

sevexal matters, including the water problem. Mrs ,
Hester Leaverton, a resident since 1912, reque9ted
consideration for the elderly who are living on fixed
incomes and attempting to maintain attractive lomes ,.
Mr. Conant Halsey, 300 La Colina Drive, exire 88ed
concern for those people residing outside the city
as did Ai Newell. Mrs . Phyllis Eldridge addressed
Council with concern. Sherril Grenier of Mentone
expressed concern for the people of Mentone wh(.,,'',

around their homes .
Chairman of the Public Works Commdavion, Fred Ford,
explained that the original increase in water rate.

sale of water bonds which were repaid by the citizens
living within the Redlands city limits ; this was the
only way to make the situation equitable,

vice Mayor Knudsen expressed concern for the impact
on citizens ' budgets and added that a hearing should
be held, He moved that Council hold the rate increase
in abeyance to allow people to study the matter and
make presentations at a public hearing one month from
today at the Council meeting cf May 18, 1976, Ccunnii-
man Elliott seconded the mcticn
Councilman Elliott also expressed concern for the
elderly on fixed incomes subsisting on meager checks,
and questioned whether the City staff could make an
alternate solution to handle the 8pecial ptcbiemy of
people on fixed incomes ,
Councilwoman Grace reminded the Council and the audience
that these identical problems were reported a year age,
when the department requested a twenty percent 20%
increase, but instead the Council transferred fundz
from the Legal Capital Fund and initiated an eleven
percent (11%) increase, She pointed out that unfor-
tunately the Legal Capital Fund is now expended at
this time. Councilman Miller stated that he saw nc
way out except tc grant an increase, and ifthe deteri-
orating system is not improved, there will be nc water

have been available every Monday night in City Hall
if people wish to come in and speak about a matter,
Mr. Larry Funk, 40 East Cypress Avenue, agreed with
Councilman Miller and stated that the City staff
should have told us this ten years ago and reco.mmended
budgetary ac-counting,
Vice Mayor Knudsen 's motion was then repeated, seconid
by Councilman Elliott and adopted by the following roll.

Mr. Mitchell recommended that the Public Works Com-
mission be requested to assist the staff in reviewing
the input from the citizens , Mr. Ford stated that the
Public Works Commission can hold an open meeting fcr
any input at their next Commission meeting- and
that they will possibly hold an announced evening
meeting,
On motion of Councilman Knudsen, seconded by Council-
woman Grace, the Public Works Commission was asked
to attend the public hearing at the t"",ouncil meeting
on May 18, 1976,,
On motion of Councilman Miller, seconded by Vice mayor
Knudsen, Council requested that the Public Works
Commission hold a meeting in two weeks .

The m8eting was cpsned with the singing of ene 8tanza of
God Bless America, the pledge of allegiance, and the
invocation by Councilman Miller. Minutes of the regular
meeting of March 16, 1976, and the adjourned regular
meeting of March 23, 1976, were approved as submitted,

Park Commission - City Manager Merritt brought the Park
Commission r ecomm8ndat ion from the meeting Gf March 18,
1976, that the Council purchase equivalent land tc-
replace all park land used for any other purpcse than
parks. Also the Commission inquired what plans were
Park being made fay replacing the 1.87 acres of park land
Land and open space areas in Lugonia Park being given to the
Use Nbrthside Community Center, The matter was discussed
briefly Wuncilman Elliott observed that the people to
be served by the NOrthside Community Center were the
people who recommended the use of the land. Mr . Elliott
also pointed out the proximity of Texonia Park and
Lugonia Park and questioned the amount these are used,
Councilwoman Grace announced the April 15, 1976, Park
Commission meeting at which time the Commission will
consider a new park ordinance, She invited any input
citizens would like to give

Shefchik presented the recommendation of the Public Worka
Department staff for restructuring the City's existing

water rates as shown on Table 9, Appendix B, Page B-24,
of the Redlands Water Master Plan prepared by J. Ma
Montgomery, Engineers . He explained the rate briefly
and stated that the Public Works Commission approved
this recommendation at their meeting of March 29,, 1976a
Mr. David Turner read a statement questioning the
Montgomery Report and requesting a delay in this matter,
Mr. David Garcia, Director of Municipal Services, ex-
Water plained the years of deterioration which the water
Rate system has suffered, particularly the 60-65 miles of
Increase four-inch pipeline which are no longer capable of
adequate water delivery; stressed the fire hazard; and
explained that a six percent (6%) increase in new con-
nections has been added while the water staff has been
reduced 8.6 percent..
Fred Ford, Chairman of the Public Works Commission,
addressed Council requesting the implementation of the
Montgomery recommendation and the acceptance of the
Montgomery report.
Mr. Eldon Vincent, present in the audience, gave a
comprehensive comparison of the water system with that
of Azuza and projel-ted future costs of the water uses
in Redlands . Mr. Louis Fletcher explained that gravity
water, while reasonable, was not without cost. Mr ,
Turner suggested that the City develop alternates and
recommended a twenty-one percent (21%) increase, Mr.
Garcia further explained that this requested increase
is to maintain the present level at which the City is
receiving water service and not for capital improvement
nor for projected population increase, He added that
surplus funds are now depleted.
Fire Chief Budd cited one instance of a costly home on
Knoll Road which was lost to fire due to the inadequency
of the water pressure in the early 1950 's ,, Councilman
Miller moved to accept the Commission recommendall--ion
and approve the rate increase. The motion was seclonded
by Councilman Elliott with each Co-uncillmember expressing
concern for the citizens ' situation brought about by
