HomeMy WebLinkAbout6569_CCv0001.pdf RESOLUTION NO.6569 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING AND DETERMINING THAT THE USE OF MONIES FROM THE LOW AND MODERATE INCOME HOUSING FUND OUTSIDE THE BOUNDARIES OF THE REDLANDS REDEVELOPMENT PROJECT WILL BENEFIT THE PROJECT AND AUTHORIZING THE EXPENDITURE OF SUCH FUNDS WHEREAS,the Redevelopment Agency of the City of Redlands(the "Agency")is a redevelopment agency organized and existing under the California Community Redevelopment Law (CCRL); Health and Safety Code Section 33000, et seq.; and WHEREAS, on September 26, 1972, the City Council of the City of Redlands (the"City Council") adopted Ordinance No. 1500 establishing a redevelopment plan for the Redevelopment Project(the"Project"); and WHEREAS, on February 17, 1976, the City Council adopted Ordinance No. 1575, which added additional territory to the Project; and WHEREAS,on December 16, 1986,the City Council adopted Ordinance No. 1974,which amended the Project to set limits on the receipt of tax increment funds,the time for the establishment of indebtedness payable from tax increment funds and the timeframe for the commencement of eminent domain proceedings; and WHEREAS,on November 5, 1996,the City Council adopted Ordinance No. 2336,which amended the Project to bring it into conformance with the provisions of Assembly Bill 1290; and WHEREAS,on December 19,2000,the City Council adopted Ordinance No.2464,which amended the Project to reauthorize the power of eminent domain for non-residential real property; and WHEREAS,on September 19,2003,the City Council adopted Ordinance No.2556,which amended the Project to expand the power of eminent to all real property; and WHEREAS, on November 4,2003,the City Council adopted Ordinance No. 2560,which amended the Project to extend the effectiveness deadline and the deadline to repay indebtedness for one year pursuant to Section 33333.6(e)(2)(C)of the CCRL; and WHEREAS,CCRL Section 33334.2 requires that no less than twenty percent(20%)of all taxes which are allocated to the Agency pursuant to CCRL Section 33670 be used by the Agency for purposes of increasing,improving,and preserving the community's supply of low and moderate income housing available at affordable housing costs ("Low and Moderate Income Housing Fund"); and WHEREAS,pursuant to CCRL Section 33334.2 the Legislature has declared its intent that the Low and Moderate Income Housing Fund shall be used to improve, increase and preserve housing in the community; and WHEREAS, CCRL Section 33334.2(g) authorizes the Agency to use monies from the Low and Moderate Income Housing Fund inside or outside the Project area, but the Agency may only use the funds 6564 1 outside the Project area upon resolutions of the Agency and the City Council finding that such use will be of benefit to the Project; and WHEREAS, pursuant to CCRL Section 33334.2(8), the Legislature declares that the provision of replacement housing pursuant to CCRL Section 33413 is always of benefit to a Project area; and WHEREAS, residents of housing located within the City, but outside of the Project area may be employed within and will use services and patronise businesses located in the Project area; and WHEREAS,the City Council desires by this Resolution to declare that the expenditure of monies from the Low and Moderate Income Housing Fund outside the Project area for purposes authorized under the CCRL are and will be of benefit to the Project. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS DOES HEREBY RESOLVES AS FOLLOWS: Section 1. The above recitals are true and correct. Section 2. The expenditure of monies from the Low and Moderate Income Housing Fund outside the Project area for purposes authorized under the CCRL, is and will be of benefit to the Project. Section 3. The Agency is authorized to expend monies from the Low and Moderate Income Housing Fund for said authorized purposes under the CCRL. Section 4. The City Clerk shall certify to the passage and adoption of this resolution,and it shall thereupon take immediate effect and be in force.
