Bailey and Nancy S. Bailey, hereinafter referred to as "Declarant. " WHEREAS, Declarant is the owner of Lot 9 and the west one-half of Lot 6 , Tract 2199 , Westwood Subdivision No. 1 in the City of Redlands as per plat recorded in Book 32 of Maps , Page 13 , in the Office of the Recorder of San Bernardino County; and WHEREAS , Declarant has been granted a variance by the City of Redlands to permit installation of a kitchen in an accessory house on said property, to be converted into a quest house thereon , conditional upon Declarant recording a Declara- tion of Restrictions providing that said house will be occupied by members of the family residing in the main house thereon , or their guests only, and shall not be rented to others ; NOW, THEREFORE, Declarant declares that said real property shall be held , transferred , encumbered, used , sold, conveyed, leased, and occupied subject to the following covenant: Upon installation of a kitchen in the accessory house located upon said property, said accessory house shall be deemed a guest house which shall be occupied only by members of the family re- siding at the 'main house located upon said pro- perty, or their guests , and said guest house shall not be rented to any person. The document contains the covenant required for Variance No. 288, which permits the installation of a kitchen in an accessory house to be converted into a guest house. Please note that the enclosed Declaration does not require the signature of the Mayor and City Clerk. I am con- cerned that signature by the Mayor might require authorization by the City Council, and I am sure that the Planning Commission did not intend to require action by the City Council . Please advise the Baileys that their signatures must be executed in the presence of a notary public in order for the document to be recorded.
