RESOLUTION NO. 7651 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS LEVYING SPECIAL TAXES WITHIN CITY OF REDLANDS COMMUNITY FACILITIES DISTRICT NO. 2004-1 (Tract No. 16408; Tract No. 16287; Tentative Tract Map No. 17253; Parcel Map No. 17353; CRA No. 826; Tract No. 16806; Parcel Map No. 16806; Parcel Map No. 18208; Parcel Map No. 19731; Tract Map No. 16465; Tract Map No. 16627; Tract Map No. 18882; Parcel Map No. 19496) WHEREAS, the City Council (the "City Council") of the City of Redlands (the "City") has formed City of Redlands Community Facilities District No. 2004-1 (Tract No. 16408 — Centex Homes) and annexcd Tract No. 16287 (Annexation No. 1), Tentative Tract No. 17253 (Annexation No. 3), Parcel Map No. 17353, (Annexation No. 4), CRA No. 826 (Annexation No. 5), Tract No. 16806 (Annexation No. 8), Parcel Map No. 18208 (Annexation No. 9), Parcel Map No. 19371 (Annexation No. 11), Tract No. 16465 Tract No. 16627 (Annexation No. 12), Tract No. 18882 (Annexation No. 13), and Parcel Map No. 19496 (Annexation No. 14) into the City of Redlands Coininunity Facilities District No. 2004-1 (the "Coniinunity Facilities District"), under and pursuant to the Mello-Roos Community Facilities Act of 1982 (the "Act"); and WHEREAS, the City Council, as the legislative body of the Community Facilities District, is authorized under the Act to levy special taxes (the "Special Taxes") to pay for the costs of certain facilities and to authorize the issuance of bonds secured by the Special Taxes under the Act; and WHEREAS, the City Council, pursuant to Ordinance No. 2584, adopted by the City Council of the City on August 3, 2004, and Resolution No. 6481, adopted on May 2, 2006, authorized and levied the Special Taxes within the Community Facilities District; and WHEREAS, Section 53340 of the Act provides that the legislative body of a community facilities district may provide, by resolution, for the levy of the special tax in the current year or future tax years at the saine rate or at a lower rate than the rate provided by ordinance, if the resolution is adopted and a certified list of all parcels subject to the special tax levy including the amount of the tax to be levied on each parcel for the applicable tax year, is filed by the clerk or other official designated by the legislative body with the county auditor on or before the 10th day of August of that tax year; and WHEREAS, the City Council desires to levy the Special Taxes within the Community Facilities District for Fiscal Year 2016-2017; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. The City Council hereby levies the Special Taxes for the Fiscal Year 2016- 2017 at the maximum rates and with respect to the parcels as set forth in Exhibit A hereto, provided, however, that the City Manager or the Finance Director of the City is hereby authorized, prior to the submission to the San Bernardino County Auditor/Controller and upon consultation. with the City's special tax consultant, Albert A. Webb Associates (a) to make any necessary modifications to such Special Taxes to correct any errors, omissions or inconsistencies in the listing or categorization of parcels to be taxed (provided that any such modifications shall not result in an increase in the Special Tax applicable to any category of parcels), or (b) to lower such Special Tax rates to the extent such officer deems necessary upon receipt of the final pricing inforination. The City Clerk of the City is hereby authorized and directed to file with the San Bernardino County Auditor/Controller no later than August 10, 2016, a certified list of all parcels subject to the Special Tax levy including the amount of the Special Tax to be levied on each parcel for Fiscal Year 2016-2017. Section 3. The officers and agents of the City are, and each of them hereby is, authorized and directed to execute and deliver any and all documents and instruments and to do and cause to be done any and all acts and things necessary or proper for carrying out the levy of the Special Taxes for Fiscal Year 2016-2017 as provided in this Resolution. Section 4. All actions heretofore taken by the officers and agents of the City with respect to the levy of the Special Taxes for Fiscal Year 2016-2017 are hereby approved, confirmed and ratified. The CFD was developed to cover the ongoing cost of maintenance of street trees, citrus groves landscaping and other appurtenances located along Fifth Avenue and Wabash Avenue. In May 2006 Council approved Annexation No. 1 (Tract No. 16287) to the CFD, located at accidental Drive and Crystal Court for the maintenance of landscaping and water quality treatment devices in the open space lots. During this last year, Annexation No. 1 subdivided the properties on site from two lots to twelve lots. Annexation No. 2 (Tentative Tract No. 16586), located north of 1-10 and both sides of the proposed Wabash Street alignment has been on hold since October 2006. In July 20106 Council approved Annexation No. 3 (Tentative Tract No. 17253) to the CFD, located at the southwest corner of Lugonia Avenue and Church Street for the maintenance of the landscape and the associated irrigation equipment on Lugonia Avenue parkway frontages. This project has not yet begun construction. In October 2008 Council approved Annexation No. 4 (Parcel Map No. 17353) to the CFD, located at Ford Street and Interstate 10 for the maintenance of the landscape in the median island and the associated irrigation equipment. In October 2008 Council approved Annexation No, 5 (Commission Review and Approval No. 826) to the CFD, located at California Street and Orange Tree Lane for the maintenance of the landscape in the median island and the associated irrigation equipment on California Street and the parkway frontages along both streets. Annexation No. 6 (Tract No 14790-1), located adjacent to Sunset Hills Lane, west of Alessandro Road did not receive sufficient votes needed to annex into the CFD in June 2009. Annexation No. 7 (Parcel 2 of Parcel Map No. 15578), located at the northeast comer of San Bernardino Avenue and Mountain View Avenue, has been on hold since February 2011. In February 2011 Council approved Annexation No. 8 (Tract No. 16805) to the CFD, located at southeast comer of Pennsylvania Avenue and Texas Street for the maintenance of the landscape and the associated irrigation equipment on Pennsylvania Avenue and Texas Street parkway frontages, This project has not yet begun construction. Attachment B to RCA— Levy Special Taxes Within City of Redlands Community f=acilities District No. 20041 Council Meeting of 715116 In November 2012 Council approved Annexation No. 9 (Parcel Map No, 18208) to the CFD located at the southeast comer of Redlands Boulevard and Nevada Street for the maintenance of landscaping and the associated irrigation equipment on Redlands Boulevard and Nevada Street parkway frontages and the Redlands Boulevard raised center median. Annexation No. 10 (Tract No. 18762), located at the northeast comer of Orange Street and Lugonia Avenue, has been on hold since September 2015. The property is still in the maintenance time period required of the developer prior to acceptance of improvements. In June 2014 Council approved Annexation No. 11 (Parcel Map No. 19371) to the CFD located at the northwest corner of Lugonia Avenue and Wabash Avenue for the maintenance of landscaping and the associated irrigation equipment on Lugonia Avenue and Wabash Avenue Street parkway frontages. Annexation No. 11 is dormant because the property owners have agreed to be responsible for all landscaping and irrigation efforts themselves; therefore the annexations are not being assessed. In June 2014 Council approved Annexation No. 12 (Tract Map Nos. 16465 and 16627) to the CFD located at the southwest and southeast corners of Pioneer Avenue and Judson Street, respectively, for the maintenance of landscaping and the associated irrigation equipment on Pioneer Avenue and Judson Street parkway frontages, maintenance of landscaping and water quality treatment devices in the open space lots, and for the maintenance of landscaping and the associated irrigation equipment on the common area lots. Annexation No. 12a (Tract No. 16465) is currently under construction and is stili the responsibility of the developer. In June 2014 Council approved Annexation No. 13 (Tract Map No. 18852) to the CFD located at the southwest corner of San Bernardino Avenue and Dearborn Street, respectively, for the maintenance of landscaping and the associated irrigation equipment on San Bernardino Avenue and Dearborn Street parkway frontages and for the maintenance of landscaping and the associated irrigation equipment on the common area lots with the exception of Lot B. Annexation No. 13 is dormant because the property owners have agreed to be responsible for all landscaping and irrigation efforts themselves; therefore the annexation is not being assessed. In September 2015 Council approved Annexation No. 14 (Parcel Map No. 19496) to the CFD located at the northeast comer of California Street and Lugonia Avenue for the maintenance of landscaping and associated irrigation equipment on the California Street center median. The maintenance of landscaping and associated irrigation equipment on California Street and Lugonia Avenue parkway frontages will be maintained by the property owner and will not be assessed.
