PUBLIC COMMENT: Closed Session Participants — Steve Rogers noted that the City Manager is not indicated as participating in the discussion of some items on the closed session agenda. He asserted that the Manager should be present for all discussions. He also distributed and referred to a letter he wrote to the City of Redlands Human Relations Commission highlighting his frustration in working with city staff. CLOSED SESSION: The meeting recessed to a closed session to discuss the following: 1. Conference with legal counsel: Anticipated Litigation - Government Code §54956.9(4)(2) and(e)(3) - Three Cases a. Consideration of claim filed against the City of Redlands by Maureen Villena b. Consideration of claim filed against the City of Redlands by Southern California Edison Company c. Consideration of demand for reimbursement of costs by the United States Environmental Protection Agency 2. Thompson, San Bernardino County Real Estate Services Department Under negotiation: Terms of payment and price for the purchase of City and County of San Bernardino property The meeting reconvened at 6:07 P.M. with an invocation by Mayor Pro Tem Harrison and the pledge of allegiance to the American flag. CLOSED SESSION REPORT: No reportable action was taken by the City Council during the closed session. PRESENTATIONS: Redlands Animal Shelter —Animal Control Officer Bill Miller introduced "Sammy", a two year old male Chihuahua, who is available for adoption along with twenty-four other dogs and forty-four cats at the Redlands Animal Shelter. Officer Miller announced that twenty-three dogs, seventeen cats and eight rabbits were adopted since the last City Council meeting. Woman of the Year —Assemblyman Marc Steinorth presented a certificate to Youth Hope founder Heidi Mayer in recognition of her selection as the 40th Assembly District Woman of the Year for her work with homeless children. PUBLIC COMMENTS: Highway 210 Widening — Cheryl Donahue, of the San Bernardino Associated Governments, announced a public hearing to be held on June 2, 2016, from 5:00 P.M. to 7:00 P.M., at Beatty Middle School in Highland, to address a project to widen and enhance the intersection of California Highway 210 and Base Line in Highland. Public comments on this project will be accepted until June 7, 2016. Neighborhood Watch — Fernando Ramirez requested consideration during budget discussions for more police patrols in the area of Colton Avenue between Eureka and Orange Streets. Discourse and Decision-making—Andy Hoder, reviewed the impacts of development decisions made by City Councils in the past and proposed an atmosphere or process more conducive to a dialogue between government and the governed citizens of Redlands going forward. May 17,2016 Page 2 High Density Housing — Greg Brittain criticized the General Plan Steering Committee for approving the inclusion of transit villages in the General Plan. He said the approval is inconsistent with priorities reflected in the survey administered prior to development of the Plan. Safety Concerns —Carolyn Hayes expressed her concerns for public safety in areas of congregating homeless transients. CONSENT CALENDAR: Minutes — On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved the minutes of the regular meeting of May 3, 2016. Proclamation — On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved a proclamation recognizing May 24, 2016 as Eritrea National Day. Fee Waiver — On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved a request from Youth Hope Foundation for the waiver of park reservation fees in the amount of$426.00 related to the Annual Day in the Park event to be held at Sylvan Park on September 10, 2016. Fee Waiver — On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved a request from the Rotary Club of Redlands for the waiver of park reservation fees in the amount of$6,050.12 related to the Touch-A-Truck event to be held at the University of Redlands stadium parking lot on June 11, 2016. Fee Waiver — On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved a request from the Volunteers for Veterans Foundation for the waiver of park reservation fees in the amount of$926.00 related to the 26th Annual Volunteers for Veterans Car Show event to be held at Sylvan Park on October 9, 2016. Lobbying Services — On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved an agreement between the City of Redlands and Innovative Federal Strategies, LLC, in the amount not to exceed $31,000.00, for federal legislative advocate services for one year. Resolutions No. 7625 and 7629 - Assessment Engineer Appointment —On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved Resolutions No. 7625 and 7629 appointing an assessment engineer and directing the preparation of the engineer's reports for Landscape Maintenance District No. 1 and Street Lighting District No. 1. May 17,2016 Page 3 COMMUNICATIONS: Passenger Rail Subcommittee — Mayor Pro Tem Harrison summarized activities to date and issues to be addressed by the Subcommittee. He discussed enhancing the design for the downtown station design to reflect architectural characteristics of the Santa Fe Historic District, potential right-of-way acquisitions, fulfilling parking needs, updating the memorandum of understanding between the City of Redlands and San Bernardino Associated Governments (SANBAG) and land use surrounding the stations. As public comment, Greg Brittain read from an article written by Norm King, former Executive Director of SANBAG, citing decreasing demand for mass transit, and restated his opposition to the Redlands Passenger Rail project. District Elections — Mayor Foster opened discussion with a review of recent court cases involving the California Voting Rights Act of 2001. As public comment, Andy Hoder expressed his opposition to any election process which calls for voting districts. On motion of Mayor Foster, seconded by Councilmember Gilbreath, the City Council unanimously approved the preparation of a Request for Proposal to retain the services of an appropriately experienced consultant to assist in addressing matters relating to the California Voting Rights Act of 2001, including the review of the possible change to district elections for City Council members. Staff was directed to return with a consultant recommendation for the Council's consideration at the regular meeting scheduled for July 5, 2016. PUBLIC HEARING: Resolution No. 7616 — Historic Resource Designation — Mayor Foster opened the hearing and called upon Loralee Farris, of the Development Services Department, to summarize a proposal to consider the historic designation of a property on West Olive Avenue. As public comment, Andy Hoder expressed his support for the designation. As the owner of the property, Ernie Dierking thanked the City staff and the Redlands Conservancy for their assistance and support during the historic designation process. On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously agreed, based on the whole of the administrative record to date, that the information contained therein justifies the adoption of a Notice of Exemption for the designation pursuant to Section 15061(b)(3) of the California Environmental Quality Act guidelines, and approved Resolution No. 7616 (Historic Resource No. 126) for the Historic designation of the single family dwelling and detached carriage house located at 433 West Olive Avenue within the R-3 (Multiple- Family Residential) District. NEW BUSINESS: Auctioning Services — Purchasing Manager Dana Abramovitz-Daniel explained the need for auctioning services. On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved an agreement between the City of Redlands and Ken Porter Auctions for auctioning services for the sale of City of Redlands surplus personal property. May 17,2016 Page 4 Annual Purchase Orders — Purchasing Manager Dana Abramovitz-Daniel presented an overview of existing annual purchase orders. On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council approved existing annual purchase orders with Lowe's not to exceed $160,000, Grainger not to exceed $180,000, Fastenal not to exceed $195,000, Home Depot not to exceed $195,000, Office Depot not to exceed $195,000, Cintas not to exceed $145,000 and Hertz Equipment Rental not to exceed $110,000 for the provision of miscellaneous tools, equipment and supplies on a need-by-need basis for total annual amounts. Miscellaneous MUED Annual Purchase Orders - Chris Diggs, of the Municipal Utilities and Engineering Department (MUED), presented a summary of the annual purchase orders for a variety of supplies such as plumbing parts, chemicals necessary for water treatment, and aggregate for street repairs, used by the department to manage water operations. On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council approved thirty-seven annual purchase orders identified by staff and totaling nearly $4,000,000.00. IT Disaster Planning — Chief Innovation Officer Danielle Garcia explained the need for information technology (IT) disaster planning. On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved an agreement between the City of Redlands and Moss-Adams LLP, in an amount not-to-exceed $73,250.00, for IT disaster recovery planning. Website Development—Chief Innovation Officer Danielle Garcia explained the need redesign and development of the City's website. On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously deemed the informal request for proposals solicitation process sufficient for an agreement for the City of Redlands website redesign and development, waived the requirement for a formal request for proposals, and approved an agreement between the City of Redlands and Reliance Communications LLC, in an amount not-to-exceed $59,000.00, for website redesign and development. Resolution No. 7623 —Wildland Fire Suppression—Fire Chief Jeff Frazier provided a history of fire protection for areas south of Sunset Drive within the City of Redlands. On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved Resolution No. 7623 approving the FY 2016- 2017 reimbursement agreement 43CA03070 between the City of Redlands and Cal- Fire for the purpose of providing wildland fire suppression resources. Gateway Beautification — Quality of Life Director Chris Boatman provided an overview of efforts to enhance the beauty of entrances to the City of Redlands. As public comment, Andy Hoder suggested the amount proposed for the project is too much and the money would be better spent on street tree trimming. Susan Broderick agreed the amount is too high, but she felt the money would be better spent for the skate park. On motions of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, the City Council unanimously agreed that approval of a contract and construction of the Redlands Entry Landscape Beautification Project is categorically exempt from further environmental review in accordance with Section 15061(c) of May 17,2016 Page 5 the California Environmental Quality Act guidelines; approved the Project plans and specifications; waived a minor irregularity in the bid; and awarded a construction contract to Clean Cut Landscape, in the amount of$1,360,463.90, for the work. Salary Schedules — Human Resources Director Amy Martin explained the need to adjust the salary schedules for the City Manager and City Attorney positions. On motion of Councilmember Gilbreath, seconded by Mayor Pro Tem Harrison, seconded by Councilmember James, the City Council unanimously approved the salary schedule for the City Manager and City Attorney effective May 23, 2016. Real Estate Negotiations —Development Services Director Oscar Orci, explained the need for an exclusive real estate negotiation agreement. On motion of Councilmember Gilbreath, seconded by Mayor Foster, the City Council unanimously approved an Exclusive Negotiating Agreement between the City of Redlands and VantageOne Real Estate Investment LLC to establish the terms and conditions of the City's purchase of property at 216 Brookside Avenue from San Bernardino County and subsequent sale of that property to VantageOne. COUNCIL,MEMBER ANNOUNCEMENTS AND ACTIVITIES: Police Department Promotions — Mayor Foster and Councilmember Gilbreath attended the Mayor's Prayer Breakfast on May 5, 2016 and the promotion and recognition event held by the Redlands Police Department on May 17, 2016. Councilmember Gilbreath has been busy with Omnitrans and CONFIRE Board meetings, a San Bernardino Associated Governments meeting and Healthy Redlands. She said the 10,000 Steps Program will be ready to start on June 11, 2016 and will run until August 6, 2016. Mayor Pro Tem Harrison represented Redlands at the Southern California Association of Governments General Assembly on May 4&5, 2016. He attended informative workshops on providing affordable housing to residents of Southern California. Mayor Foster attended a joint session of the City of Redlands Historic and Scenic Preservation Commission and the Planning Commission and thanked Ron Running and the Redlands Area Historical Society for facilitating the discussion. The Mayor also reminded everyone of the State of the City luncheon hosted by the Redlands Chamber of Commerce on June 24, 2016 at the University of Redlands Orton Center.
